1. We believe we had good relationship and we are trying our best to make
your stay convenient and happy. As landlord, we truly understood the
inconvenience caused by the broken washer and eager to resolve this issue
for sure. You knew that we have been promptly fixing any problems happened
so far. For example, the furnace was fixed overnight, the A/C was fixed
within 2 days after you noticed us.
[房客]:Past issues do not negate present issues when being a landlord.
2. Fixing this outdated washer is practically not feasible. We had the same
problem with the washer in our unit at 419 Custer, and we checked with Abt
and Sears and the answer I got was unanimously to replace this 15 year old
washer with a new one, because it does not worth fixing and mostly likely
the parts are not being manufactured anymore.
[房客]:It does not matter if the washer in your unit did not work, you flat
out refused to even attempt to service the unit in our rental. This is not
an issue of having a washer and dryer in the unit, even though we were
promised one when we signed the lease. This is a SAFETY MATTER. The unit
smells like smoke/electrical fire, which I told you at the beginning of this
entire issue. And you still refuse to have it looked at by a professional.
The unit is in our daughters bedroom, which you know. If there is any damage
that could cause a fire or any other issues, it would be in my daughters
bedroom, which is direct negligence as a landlord on your part.
3. We are still looking for the new washer to fit in that small closet: We
have visited Abt and Sears store to look for a model that will fit in the
narrow space of the closet. But unfortunately, at this moment I could not
find one yet because the new models on market are too big to fit in.
[房客]:You told me to find one, which is not my job as a tenant. [他不相信

4. We have offered an alternative compensation prior to the issue get
resolved: On 7/6/2015, we offered you $25 per month. Prior to this issue is
resolved, you can use the washer in the basement which is $1.25 per load. $
25 will give you 20 loads per month or 5 loads per week. But you rejected.
[房客]:That is not enough. And since you refuse to have the entire unit
looked at, we cannot use the dryer at this time for fear of something major
happening with the unit, which is once again, in our daughters bedroom. That
leaves only 10 loads of laundry a month. I do 10 loads of laundry a week, I
deserve four times the compensation you are offering.
5. You requested to move out: On 7/6/2015, you said that you will move out
if the washer issue is not resolved. You also requested that this action
will not be considered as breach of the lease and you will not pay the
broken lease fees. We agreed that you can moved out without paying the
broken lease fees by giving two months notices before the moving out date.
[房客]:I did request that you let us out of the lease if you refuse to even
attempt to look at the issue, because it is a safety issue for our family,
and also as a negligent landlord, you are breaking City code 5--3--3:
Maintaining Fit Premises, which I also sent you during our texting
conversations. Which means our contract is null and void if you do not fix
the issue, including giving you 2 months notice. I gave you 14 days to fix
the problem, or I will have to contact the city directly, as well as my real
estate lawyer to ensure that we can break our contract without any issues.
You will still have to deal with this issue, even if we do move out, because
it is a safety issue.
