看中某小区的townhouse，但seller info里有个附件说有HOA against Builder的官司
从去年1月开始的，原因是HOA认为builder在公共面积的一些施工不符合建规范，要
builder出钱修。
请问版上高手两个问题：
一是，如果官司HOA输了，律师费谁出？
关于官司的材料中有写：
The Association seeks attorney's fees under State Civil Practice and
Remedies Code section 38.001, et seq, State Business and Commerce Code
section 17.50(d), State Property Code 27.004(g)(6), and State Property Code
section 82.161. The Association is entitled to all reasonable and necessary
costs and attorney's fees in this case, which include attorney's fees, court
costs and fees, fees of experts, and all travel costs. Additionally,
pursuant to applicable law,the Association is entitled to recover pre-
judgement and post-judgement interest on all amounts found to be due to the
Association at the highest rate authorized by law, for which recovery to the
maximum extent permitted by law is sought herein.
可以理解为即使官司输了，诉讼费用也有相关条款落实，而不是HOA自己掏钱吧？

二是，一般这种官司几年会settle？

1. HOA(I.e., owners)出。
2。不好讲。很多要打好几年的官司。
最好避开这样的房子。万一，你过两年要搬家换房子，但官司还在打，房子不好卖。
