The IRS has made the determination that a 5-year-old child in school is
considered to be in a kindergarten level class. The cost of the services for
instructional education is not reimbursable. If a 5-year-old child or
younger does not receive instructional education for a full day, but instead
receives daycare services for a portion of that day, the provider must
itemize a receipt with the hours of education and the hours of daycare
services. The cost for the hours of daycare is reimbursable under your
Flexible Spending Account. The cost for the hours of educational instruction
is not reimbursable.

只有双亲都上班上学的才能报daycare部分的，如果有一个不上班/上学就不行。
单亲家庭就只要那个单亲上班/上学。

我曾近打电话给我公司FSA administration的人问过这个问题， 答案是No. Daycare/
Pre-school 可以， 但Kindergarten 是No.

If your Kindergarten provides detailed reciepts explaining
which hours are for educational purposed and which hours are for care
services, the later one can be reimbursed.
Some private Kindergartens do that (full day program).

My daughter was in public full day kindgarten program.
public half day kindgarten is free, full day need to pay about $4000 per
school year (some school district has free full day kindgarten program),
which is not FSA.
full day program run from 8:30 to 3:30. We still need to pay extra for
before / after care, which can be FSA.
