First of all, thanks all of the IDs who gave valuabe suggestions or cared of my case!
The procedure is: 1), to prepare for the worst scenario, found a part-time job from one friend of mine; 2), one week after occupying the part-time job, went to the interview; 3),two week after the interview, received both my wife's and my Green Card!
Experiences I have learned from the bold experiments(In fact I had no other option at all!):
#1: 失业救济(Unemployment Insurance) 100% SURE is available after receiving EAD. Actually I applied before getting the EAD, the state approved me after I faxed in my EAD copy. NIWers after 485 filing or EB1Aers, no risk at all if you were in a postd
b. If you are in the wild real world, the only risk comes your emloyer reporting your status to Immigrant, which was my case(my emloyer reported one month after my layoff and triggered the interview).
#2: EB1Aers 没工作面试没问题，只要家有存款！！！During the interview, the IO mostly focused on my wife. Basicly he just repeated the 全选“No”的questions one by one. When he asked me to show bank statements, I just showed my part-time employment let
and he asked what kind of job this is and what do I do on job, then he DID NOT ask the bank statement anymore. Obviously, in my case, BANK STATEMENT = EMPLOYMENT VERIFICATION LETTER!!! We Chineses overdress it because the GC is too important for us.
#3: Kid's USA birth certificate is a significant document for your spouse's case. The material on the interview list had no our son's birth certificate, but since we brought him there(no baby-sitter), the IO insisted to see the certificate at the beg
g and caused we thought we would fail all the way the interview.

背景：船舶工程博士，EB1A 485 TSC， RECEIVED DATE 08/29/2011，不久10月中旬不
幸被LAIDOFF,11月中旬拿到EAD后申请了失业救济。
因船舶行业在美国每况愈下，且受经济危机影响，有招工的几乎全于军方有关没绿卡不
能报，失业头3个月寄希望绿卡很快批下来万事大吉。不幸485交上4个多月没动静，无
奈下要求了EXPEDITE,今年1月被转到LOCAL USCIS OFFICE处理。预料可能被RFE工作证
明，自己创业，2月注册了一个船舶行业咨询公司，正在努力SALES/MARKETING,但还无
客户，无业绩无收入，仍在领救济。刚刚收到USCIS 4月23号面谈通知，要求材料中果
然有工作证明：current letter of employment showing rate of pay and hours per
week。
当初快失业时，曾在本坛发帖问过有关失业后RFE工作证明的问题，有热心朋友说自己
创业也能证明。现在,当真正要面对移民官时，就怕这创业无业绩不算EMPLOYMENT，从
而485被拒，一切付之一炬。
苦等7个月等来个棘手面谈，希望大家给些建议，万分感谢！！！
BTW, EB1A 485(Alien with extraordinary ability)是不是必须要这个current
letter of employment showing rate of pay and hours per week？可能是他们一直
没动我的CASE,被我找的 CONGRESSMAN一催，急急忙忙发出INTERVIEW,让我带一大堆材
料（包括已提交的 "ALL PASSPORTS AND CIS ISSUED DOCUMENTS"), 他们想省事。

不应该在没有offer情况下要求加速处理，目前看来你失业后很快就被公司report了。
因为没有1A不需要工资证明，你应该找你Ph.D的老板帮忙，搞成postdoc,给个research
associate or research title的职位。 搞到offer是正路。 就算你咨询律师也给不

know you have no job right now, that marked the red flag on your
application and made it transfered to local office. If you did not apply
UB, i think you can safely fly under the radar, tons of EB1A passed
without EVL since EB1A is already a self-petition category. If you are
not married, don't have any illegal status or criminal history in the
past, you are the first one I ever saw go to the local office interview
as an EB1 main applicant. My suggestion to you is know how to explain
the UB issue not just your EVL, i doubt just EVL caused you face
interview.
As for UB effects on 485, there is not a definite answer yet.

至少有两个老美老资格律师跟我说过eb1a的危险是通过率只有一半. 好处是如果过了
140, 根本不用担心485. 一个说他从来没见过eb1a的485还面谈的.
也就是说, 通常eb1a的140如果批了并且已经交了485, 此后, 失业不怕, 没工作不怕,
绿卡早晚都会来.
我估计您当初也是听人这说的, 但又往前走了一步, 去领救济了. 建议您领救济的绝对
是好心地害了人啊!!
如果不领救济, 根本没有这些麻烦.
可能的话, 尽快找高校的researcher, 或找家公司的part time都行(我认识的一位, 失
业后找个part time, 工资也只有一半, 但最后有惊无险地绿了),反正得证明你有相同
领域的工作就行.

for the last two years" . 可能还有一个背景：当穷学生时老婆生孩子用了CHARITY,
她的485上如实选了PULIC BENEFIT什么的那项。

但是没有工作，也没有问题， 如果移民局真的会查的话，律师说她会处理：说我会在
拿到绿卡后马上会开一个自己的公司或者我会马上set up 一个实验室。注意律师说的
是我拿到绿卡后。而且她坚信移民局会批EB1A 的485的。 她说这是最高level 的，很
难得的。
我当时也非常担心，几乎睡眠不好。也许大家担心的太多了。毕竟我们在美国太不容易
了。

但是没有工作，也没有问题， 如果移民局真的会查的话，律师说她会处理：说我会在
拿到绿卡后马上会开一个自己的公司或者我会马上set up 一个实验室。注意律师说的
是我拿到绿卡后。而且她坚信移民局会批EB1A 的485的。 她说这是最高level 的，很
难得的。
我当时也非常担心，几乎睡眠不好。也许大家担心的太多了。毕竟我们在美国太不容易
了。

IO mostly focused on my wife. Basicly he just repeated the 全选“No”的
questions one by one. When he asked me to show bank statements, I just
showed my part-time employment letter, and he asked what kind of job this is
and what do I do on job, then he DID NOT ask the bank statement anymore.
Obviously, in my case, BANK STATEMENT = EMPLOYMENT VERIFICATION LETTER!!! We
Chineses overdress it because the GC is too important fo: r us.
s case. The material on the interview list had no our son's birth
certificate, but since we brought him there(no baby-sitter), the IO insisted
to see the certificate at the begaining and caused we thought we would fail
all the way the interview.
