A friend of mine is a J-1 scholar.
He came to U.S. as J-1 and stayed for three months in 2007.
Then, he went back to China for three months and come to U.S. in 2008 as J-1
again.
Can he claim treaty benefit for his wages paid by U.S. employer in 2008?
He didn't even use the treaty benefit in 2007 because he got funding from
China and not get paid by U.S.

Nobody answer this question since I posted last week.
I found the answer by myself today, and I want to share with people who have
encountered the same situation.
First, he is eligible for treaty benefit starting from the day when he
entered U.S. on his first J-1 visa in 2007. It doesn't matter if he used the
treaty or not. 2007 counts toward his 3 year (aggregate)in terms of the
treaty benefit.
Second, in order for his treaty benefit to apply, he needs to go back to
China and stay for at least
