我的经历,回复:在加拿大转机回国,回来时也是在加拿大入境,会不会有问题
Hi: For this question, simply saying it is OK, but it was not very smoothly.
My ticket was from Newark, NJ to Toronto, then Toronto to Beijing. Then from
Beijing to Toronto, then Toronto to Newark, NJ.
Leaving the US,in Newark Int'l airport: the officer asked me whether I have
a valid VISA to enter U.S. I said, I do not have. I will apply in Beijing.
My entering visa has expired but I have valid STATUS in US, I am H1b Status,
I am legally working in U.S. The officer did not understand the things well
. She did not let me check in. She thought you do not have a legal VISA to
enter U.S. and then you cannot enter Canada. She thought I cannot go to
Canada, even just connected/transition in Canada. I said, I want to see your
supervisor. I waited for a while, then the supervisor came out. I explained
to her carefully. The she said, it is OK, but you should surrender BOTH I-
94 in the boarding gate, i.e. one is your white hard copy I-94 (the one when
you entered the U.S.), another is the I-94 on your I-797 approval notice,
the right bottom. Then the first office felt shame that she does not
understand this things well. But they called the situation as 'Minor
document'. It took me totally more than half an hour in the check-in desk
that day. So if you are going to connect in Canada, be arrive in airport
earlier.
But in the gate, when I gave the officer both I-94, but he gave back me the
right bottom part of I-797, saying you may need it in Canada to show your
legal status in U.S. Then in Toronto, the officer checked my I-797, then let
me in without saying anything, i.e. not aking me to give her the right-
bottom part of I-797. I had walked away. Then I thought for a while, and
went back to her. I said, I think I need to give the I-94 (right-bottom of I
-797) to someone here and it should be returned to U.S. She looked at th
instruction in the back of the I-94. Then she said, I should be the officer
to take it. I gave the I-94 to her. She said, we will return it to U.S.
In fact, I do not know whether I insisted on giving the I-94 to her is
necessary or correct and I did not know whether it DOES return to U.S.at all.
In Beiing, U.S. Embassy: when I was interviewed there for returing visa,
when the officer (a lady) saw the right-bottom part of I-797 was gone, she
was very happy and said, Oh, you are already in U.S., I said, yes, I am
working there. (!!! So when you in Embassy, be SURE to give the visa officer
the I-797 without the I-94 part, even you did not surrender it to the
officer in the airport). I got the visa smoothly. I may post on Mitbbs later
about my that experience.
Returing, Beijing Int'l airport: in the check-in desk, the girl(in fact, the
girl is a staff of Air China not Air Canada.) asked me if I had a visa to
Canada, I said, no, but I had a visa to U.S. then she phoned her supervisor.
I heard in the phone, her supervisor said, 'Let her go'. Then the girl let
me in. It did not stuck this time.
Then in Toronto airport, I was checked by a U.S. officer, she asked me why
are you going to U.S., what are you doing in U.S., and do you have something
to declare, then she let me in. She put a stamp on my passport. !!!Be sure
to look at what the officer write on the stamp, to make sure it is correct.
One more information: now I-94 card for entering is electronically, i.e. you
do not need to fill the form on the air place at all. There is a website to
retrieve your I-94 online if you need your I-94 information. I just knew
this AFTER I returned to U.S.
Toronto is the place I was checked whether I can enter to the U.S. and then
when I arrived Newark, NJ, no any checking and I just entered.
