法院判决书显示，13岁的周某在南丹县里湖瑶族乡仁广小学读书，与不满13岁的覃
某是六年级同班同学，平时两人关系比较好，且两家都是同一条街上的邻居，住房相隔
不足150米。覃某因同学们喜欢与周某玩耍，并曾议论她长得胖、不及周某漂亮，而对
周某心生嫉妒并怀恨在心。
判决书显示，2012年4月10日傍晚，覃某邀请周某到家中玩耍，周某到覃某家中后
，两人在家中看电视时，覃某乘周某低头玩手机之际，用木凳砸周某头部并至其晕倒。
因害怕周某醒后告诉老师和家长，便从家中找来菜刀、啤酒瓶、割纸刀、剪刀等凶器，
对周某行凶，至周某当场死亡。后覃某还将周某头颅、手臂砍断，装进塑料袋，并清理
案发现场血迹。
广西公安机关认定被告覃某故意杀人，因其作案时未满十四岁，依法不追究刑事责
任，决定对覃某收容教养三年。周某的父母向法院提起诉讼，广西南丹县人民法院判处
，覃某父母已赔偿原告1万元前提下，还需赔偿原告共9.8万元。周某父母不服，提起上
诉。
近日，广西河池市中级人民法院终审判决维持原判。

凶嫌的间接证据。在陪审团于10月宣布判决时，爱斯提本也照样维持没有任何表情的面
容。
在屋仑召开的审讯中呈堂的证据显示，被告先调查死者的行踪，再于2011年5月27
日到希活市凯撒医院停车场杀害死者，随后开着死者的汽车，将尸体载到菲蒙市以东的
Sunol Canyon小径丢弃。
罗列夫森透露，爱斯提本曾向一名感化官表示，自己遭到错误定罪，但又补充说，
如果她是陪审员的话，依据呈堂的证据也会将自己定罪。
毫无悔意难获假释
法官表示，爱斯提本必须先表示后悔，才可能获得假释，但迄今他没有见到凶嫌流
露丝毫悔意。
爱斯提本的律师奥尔表示，当事人曾对她说：“安德莉亚，算了吧！”那似乎就是
承认犯罪。奥尔未提出要求召开新的审讯的动议。
家属指正义获得伸张
黎米雪的兄弟麦克表示，爱斯提本的判刑是最重可判处的刑期，他们很高兴某种形
式的正义已获得伸张。
爱斯提本在为期三周的审讯中没有上台作证。检察官表示，被告与死者在圣地牙哥
上同一所高中，曾经是最要好的朋友。

Michelle Hoang Thi Le was a 26-year old nursing student who disappeared on
May 27, 2011 from the Kaiser Permanente Medical Center in the San Francisco
Bay Area city of Hayward, California. Le's car was found the next morning
around 9 am parked on Ponderosa Court, about half a mile from the medical
center. Le grew up in San Diego County and moved to the San Francisco Bay
Area for college and nursing school at Samuel Merritt University in Oakland,
California.[1]
Her family put up billboards and offered a $65,000 reward for information
about her whereabouts.[1] Over the next four months at least eight volunteer
search efforts were undertaken, some organized by the Klaas Kids Foundation
,[2] founded by Marc Klaas after his daughter Polly was kidnapped and
murdered in 1993. A variety of missing persons organizations joined in the
searches. The eighth search found decomposed human remains in a remote
canyon area on September 17.[3] On September 19, 2011 the Alameda County
coroner's office positively identified the remains to be those of Michelle
Le.[4]
Police suspected from the beginning that she had been killed by someone she
knew.[1] Giselle Diwal Esteban (27) of Union City, California, a Filipino-
American former friend of Le, was arrested on September 7 and charged with
her murder, although a body had not yet been found at that time. Authorities
said that they had DNA evidence in the form of blood stains found in Le's
car and on Esteban's shoe, and that security video footage confirmed Esteban
's presence in the area at the time Le disappeared.[5] Esteban allegedly
blamed Le for ruining her relationship with her ex-boyfriend, with whom she
had a child, but denied any involvement in Le's disappearance. Esteban was
indicted on a murder charge December 14, 2011.[6] She entered a not-guilty
plea.[7] A trial date was set for September 17, 2012.[8]
