I copied these from our patent training, it should answer your question:
What you can NOT patent:
1. An idea- reduction to practice is necessary, reduction to practice can be j
ust a description of an implementation.
2. Something obvious to someone skilled in the art
3. Something that has already been patented or otherwise publicly disclosed/kn
own, unless you can show that you thought of it first and were diligent (in th
e USA, e.g. signed, dated, and witnessed logbook entries)
