靠，等了好久，今天收到一封USCIS的信，还激动了一下，打开一看，发现内容是要求我withdraw
OPT!!!
说我因为H1B批准了，as such, the applicant has no longer for status F1 academic
student. The OPT requested has been terminated on SEVIS system, the SEVIS
system did not update the dates of employment and nor, these dates of
employment did not appear in the SEVIS school system. Therefore, the applicant
is not eligible for the benefit being sought.
For this reason USCIS requests that the applicant withdraw this application
I-765, as it would serve n

我原来实习的老板实验室的一个学生挺倒霉的，她的一篇超级牛的JEM的paper被
retract了。我听说她的paper还是cover。因为老板胃癌突然去世，去世不久，这个phd
学生就发了之前提交的一篇文章，正是有FOXP3+的macrophage。估计老多人都觉得
FOXP3是Treg的标记，但是她的paper貌似反驳这点，所以很novel。今天一看retract说
明，太惨了，因为没人信，老板死了也不能回复，data有丢失，结果DEAN就把PAPER
retract了。
这篇paper真的有那么严重到retract的地步吗。虽然我自己看不太懂。

H1B批准的是2011年的，还没生效呢，凭什么现在就不能是学生身份？
我2月拿到offer，3月22号file OPT, 4月1号file H1B, 6月毕业, 6月开始工作
有什么不对吗？

第一次看到这篇报道时觉得不太可信，奇怪Jem竟然发这种不踏实的文章，所以被

不过你申的应该是今年的h1b吧?

能否展开说说您怎么在第一次看到这个文章的时候就认为不可信，这文章如何做得不踏
实呢，真心请教.
我主要对这种根据表达某一个分子来定义一个细胞群的方法心存疑虑。没有细看这个文
章，不知道他们是怎么分离这个Foxp3+细胞群的，说不定是污染了其它细胞呢。但是整
个IDEA 应该说还是 reasonable 的吧，比如说 alternatively activated macrophage
就是 anti-inflammatory的

我多说几句，理由很简单，别的实验室不能重复“ JEM received data from several
laboratories that independently attempted, but ultimately failed, to
reproduce the findings of Zorro-Manrique et al. In the opinion of the
Editors, these data compellingly undermine the conclusion that a distinct
population of immunosuppressive CD11b+F4/80+ macrophages expresses Foxp3 in
naive and tumor-bearing mice.”
几年前，Cell上有文章说cancer cell 表达 foxp3 （http://www.ncbi.nlm.nih.gov/pubmed/17570480），但是行内的人都不信。 foxp3 太有名太重要了，有太多的实验室研究了。这篇文章的结论如果是正确的话，就不会委屈发在jem上了。
估计是被Rudensky搞死的。

Rudensky有那么坏？
另外我想请教一下，今年Richard Flavell的组发了篇nature讲Th-17在小肠中变成
regulatory Th-17，IL-10的mRNA很高。会不会也是Th-17的Foxp3 gene表达出来了导致
的？另外我觉得macrophage能表达Foxp3不应该觉得奇怪，因为macrophage本身就有
inflammatory和anti-inflammatory的表型啊。。

如果6月份毕业，没有opt的话，只有2个月的grace period，status只能维持到8月份呢。有opt了，就没有问题了。不知道我的理解是不是错的。
小尾羊还是要详细咨询一下。

我记得H1B可以提前两个月入境，如果没记错的话，这个正好更他的F1接上，所以身份
不是问题。

呢。有opt了，就没有问题了。不知道我的理解是不是错的。

会只有我一个。
H1B 4月才能申请，OPT毕业前3个月才能申请(按我们学校IC的说法)，而H1B的处理时间

最核心的问题是：H1B approved but not taking effect, why the hell do they

你具体是6月几号毕业？如果有OPT的话，依然是F1，从10月1号开始就变成h1身份。
如果没有OPT了，就让人觉得很困惑。

我lg申请的时候就担心过这个，问公司的律师说没问题，学校的律师说可能会有问题。
现在他的pre－opt已经批了，可是post－opt也还在review中。。。希望不要也

第一句话就不对。如你所说，你的H-1B要到十月一日才能生效，生效之前，你仍然是F-
1 身份。

好希望小尾羊这个事情能尽快的完满解决。
另外，请问满老，我在精华区里面翻出了一个帖子，好像还是你以前整理的，他是这样
说的：
下面分两种情况来谈H-1B的生效方式和OPT的关系。
一、
如果你的I-20的有效日期或者有效日期＋60天grace period能够cover到H-1B生效之日，
也就是说，你可以在美国连续合法居留，
则无论OPT如何处理，
你的H-1B批复都会附有新的I-94，属境内生效；
二、
如果你的I-20的有效日期＋60天grace period不能cover到H-1B生效之日，
你就要借助OPT来cover这个GAP了。
则又可细分出甲、乙两种情况：
情况甲
如果你申请H-1B的时候，OPT已经批准，
则这个GAP肯定能够被cover，
你的H-1B批复会附有新的I-94，属境内生效；
情况乙
如果USCIS批准你的H-1B申请的时候，OPT仍然处于pending状态，
由于这段GAP还没有被cover，
你的H-1B批复就不会附有新的I-94，属境外生效，
你就必须出境，到驻外美领馆拿到H-1B visa stamp来激活你的H-1B status.

H-1B没有问题，
和学校再确认一下你的SEVIS account的status。
如果仍然有效，就再申请一次OPT吧。

You should be able to reinstate your F-1 status through your school.
Terminating your F-1 status is a mistake that USCIS has been making in their
system. Minette will let you know how to resolve.
You should take your I-797 approval in to your foreign student advisor to
confirm you have been approved for a future date and ask that they help
correct the SEVIS record; it has not been effectuated yet; USCIS incorrectly

大家别被我这个意外的小概率倒霉例子误导了，该申H1B还是申。我就属于纯粹的背运
