来美3年多了，我的L1b已经再签过一次，2016年5月到期。公司在美国的员工太多，办
绿卡希望渺茫。请问L1b到期时可能在美国让我的雇主申请H1么？或者在美换雇主申请
H1不离境？如果可以的话，新的H1的期限有什么限制呢？最长可以是多久呢？
如果可以的话，目前的计划是等L1b过期前再申请H1签证，因为我爱人靠L2的工卡工作
。不过有好的机会和H1 sponsor的话也可以提前换雇主，我是软件工程专业本科，6年
保险和零售行业工作经验。目前的职位是TL。请各位大侠给出主意和推荐sponsor的。

我现在是H1B(有I797-A approval notice)，配偶在国内要申请H4签证。公司律师说，
只要我的H1B复印件及结婚证等及可在国内领事馆申请。但在国内申请预约时，officer
说必须要有配偶的I797A表格。我又问公司律师，回答说，没有配偶的I-797A表格，因
人不在美国。有谁知道吗，我必须要通过公司为配偶申请一个附属的I-797A表格吗？多

(1) I think the time limit for L1B visa is 5 years, not 6 years.
(2) the time limit for H1B is 6 years
(3) The length of time you stayed outside US (for example, vacation to china
) is not counted
(4) You can change to H1B visa, but your time of holding L1b visa is
combined with H1b visa to subject to 6 years limit

需要你的797和你们的结婚证,这是基本,你的797我不记得是要原件还是复印件也可以.
如果你的配偶没有797就不用.很多H4是回国返签的,所以有自己的797

需要你的I797，就是你的H1的批准件，复印件就可以了。你可以扫描EMAIL过去，然后
打印出来。

我的L1b已经续签过一次，2016年5月到期。

How can this be true? The extension of L1b visa is two years.

我第一次申请是2010年，同年10月入境。2013年5月回国再签一次，I-94是到2016年5月
的。所以我的理解应该是我可以在美国工作到2016年5月，对吗？我中间回国的时候是
重新申请的L1b不是续签。

sorry i do not understand this situation. How can you re-apply L1B visa at
5/2013?
During the period, you went back to china and worked there for more
than one year? That's the only possibility that you can re-apply.

除非你拿到L1之后在境外呆了超过一年，否则你以后申请H1时只剩下<6-L1年数>，比方
说你申请H1之前用已经L1呆了五年，那么就算公司给你申请H1，有效时间也只有一年。
