Yes, you could claim the refund. Call the state tax auditor and ask him/her
for details. Also, provide all your documents to the auditor as proof. If
they are coming for audit, just show them what you have.

ability to transfer. In general, immigration regulations allow portability
to a job in the same or similar occupation once I-485 application has been
pending for more than 180 days. However, whether the new position qualifies
for portability provisions depends on the specific details of the case. As
we did not file your I-140 petition, we are unable to provide a specific
answer for this question. You will need to work with the company’s
attorney to make this assessment.
2. To be a qualified employer for EB-1B, the company must employ at
least 3 full-time researchers in addition to you, must have documented
research accomplishments in your field, and must have the ability to pay the

1. 博后为啥能EB1B呢？难道不是需要永久工作，至少是TT才行的吗？难道你们学校特
别好？

我的title是research scientist，感觉干的就是博后的活啊：）EB1不想要排期但是有
处理时间，现在很慢的
