FYI
1, For this EB3 downgrade, are we going to go through the whole PERM process
to get a new PERM, or are we going to just use our previous PERM approval(
EB2)?
** This is not actually a “downgrade”. Rather, it is a second I140 filing
to classify the case in EB3 so you can file your green card application
immediately. Your EB2 I140 remains valid, as does the PERM that Lam filed
for you, so neither of these need to be resubmitted. The sole purpose of
the new I140 is to enable you to file your AOS immediately since the EB3
priority dates have moved ahead of EB2 for green card processing.
2, If we use the old PERM approval, and File 140 and 485 together, are we
able to use premium service for make the process faster?
** Yes, and we plan to do that.
3, Is it possible to cause any issue for such downgrade? Is it possible to
get rejected? If so, what kind of effect can it have? Will my old PERM(EB2)
got void or my priority data got void?
** No. USCIS authorizes employers to submit multiple I140 petitions in
situations like this. 

我在哪里看到是不允许premium service的因为不是新的PERM。所以这个律师有一点
overpromise。

我就简单问下律师eb2 downgrade eb3是否可能。答复居然是她已经找老板要approvals
去了。马上借用LZ的问题问她，看看是什么答复？

答案来了，
1， No, we won’t need to redo the whole PERM process. We are going to use
the old PERM approval and just file an Amended I-140 petition.
2， Even though we could file concurrently, I would debate whether we should
or not due to the complexity. I might just do I-140 first and get it
approved. Allowing premium processing is questionable.
3， It might possibly be rejected as any case would be, but there is law and
USCIS memos allowing us to submit an amended petition requesting a
different classification. Even if it gets rejected, you will still be able
to keep the old Priority Date, and we wouldn’t withdraw or revoke your old
I-140, so all would stay the same. That’s why I would think about whether
we would do concurrent filings because of the risk of paying all the money
for the I-485’s.

这其实是完全不同的两种做法。
两个140必须有两个PERM。所以，需要走PERM程序，搞一个新的140.两个140并存。
所谓的AMENDMENT，就是利用180 DAY RULE,基于老的，过期的PERM,直接在现有EB2
140做AMENDMENT,替换掉现有EB2 140为EB3 140.当然，EB3真倒退了，还是可以同样
AMEND回去EB2，链接EB2的PD。
所以代价就是律师费。如果排期在一年多以上，这么折腾也不算浪费时间，来回折腾就
是一年。

That is my lawyer's understanding, which is different than ALIA's. If EB3
regresses, we might have to file a new 140 to switch back to EB2. But he
said we do not specifically amend the old I140. I don't know if this is
doable.

AILA claims that the newly filed EB3 I140 has nothing to do with the old EB2
I140. In other words, you need to worry nothing except paying lawyer a big
fat check.

最近很忙，没时间细读各位关于降级的帖子。那天也就是随便一问，现在律师说老板同
意了。我都不知道值不值得做呢！我的EB2 PD是2011年2月的。请问各位大侠，要降级
的话，怎么做风险最小。
