被之前的公司裁員 但還會在payroll上到11月
期間找到了工作 正在辦H1B transfer 估計十月可上班
這之間可能會有幾週同時領到兩個公司的pay check 請問這樣會有問題嗎?
p.s.目前485 pending中 有EAD...不過沒啟用...

I129表上虽然transfer和new concurrent是两个不同的选项,但其实USCIS对他们的处
理似乎没有区别。如果前一个雇主不withdraw H1B,transfer批了也可以不去新雇主那
里工作,说明选了transfer但实际transfer与否并不重要。I-129上那个问题本来就很
模糊,几个选项之间并不完全mutually exclusive。楼主的新公司如果在I-129上选了
new concurrent,那肯定是可以同时为两个雇主工作的。不应该仅仅因为那个问题上选
了transfer而不是new concurrent就不可以了。

这两个确实没区别,但是两个full-time会出现冲突,不追究没事,追究起来注销身份
你也没办法,估计就算上诉赢的概率也很渺茫

也没有正式的memo或rule说不允许。法无禁止即可行。有移民律师事务所在官网上回答
多个full-time H1B是允许的,这应该是他们实际操作得来的经验。
只有为同一个雇主工作超时才有加班工资的问题,不同雇主之间的时间不累加。不然如
果你有一个全职工作,再找一个part-time,难道part-time的雇主要按加班工资的标准
支付全部工资?
另外也不是所有工作都有加班工资的,你也不知道楼主是不是exempt employee。当然
这超过讨论范围了。
我还是认为楼主只要前一个雇主的H1B仍然存在,两边都拿工资没有问题。

It is ok for an H1B to have 2 full time jobs at the same time, but it has to
through a concurrent H1B petition for the 2nd job.
If LZ begins his new job (Company B) and continues working for the prior
employer (Company A) without a concurrent H1B approval, it is a violation of
H1B status and might make his new H1B approval invalid.
By the way, as soon as LZ starts his job with Company B (not a concurrent
H1B approval), his old H1B petition for Company A becomes invalid and LZ
cannot use it anymore.
For LZ's question, it is possible to get two paychecks from two companies at
the same time (especially due to changing job), but it is not ok to work
for two companies without proper concurrent H1B approval.

你说的理论上有些道理,但是按我上面所说,我没发现USCIS对于transfer和new
concurrent的处理有任何区别。对于这两个选项,他们的SOP和issue的文件似乎都没有
区别。也许有其他人可以shed more light on it。

The question put to Chief LaFleur is whether Employer B can lawfully hire

petition to accommodate this situation?
Chief LaFleur responded by stating the general rule that H-1B petitions are
valid until revoked by the USCIS, the petitioner goes out of business, or

Therefore, there is no need for Employer B to file a new or amended petition.

I still believe in the above example, the employee can choose either A or B,
but not both of them at the same time if no concurrent H1B.
