E. EMPLOYMENT FIRST AND SECOND PREFERENCE VISA AVAILABILITY
Item F of the May Visa Bulletin (number 44) provided projections regarding
visa availability in the coming months. Information received from the USCIS
after the publication of that item requires an update in the projections
for the Employment First and Second preference categories.
Employment First: Based on the current rate of demand, it may be necessary
to establish a cut-off date at the end of the fiscal year in an effort to
limit number use within the annual numerical limit.
Employment Second: Based on the current rate of demand, it may be necessary
to establish a cut-off date for this category for all countries other than
China and India. Such action may be required at any time during the next
few months.

看奥傻的意思是　阿三EB3 升级的很多，造成退到２００７年８月都不能阻止批老印的
case,　所以干脆Ｕ，卡擦干净　。

不可能再有啥SO了，因为6月的Bulletin说的很清楚：Therefore, it was necessary

No use now. They have internal memo stated EB-IC was "U" since early April.

2008PD能在2013年春天绿就不错了。
2009可以target2013年末和2014年初。
2010PD在2014-2015年之间。

明年能把08年前的27k Eb2-IC批了就不错了。假排期在13年底恐怕能走到09年初。

肯定受新的CASE，老中也就库存8000，2800+2013财年SO，肯定能消化掉大部分。O大
傻肯定在明年暑假会开闸收新的。O大傻也暗示了说到明年spring不受新的case，也就
是说，明年spring后因该会放水。

EB3升级过来的老印PD要多早有多早，老中能分到几个SO很成问题。
8000库存，2013财年非常有可能消化不完。

这肯定是原来ported。后来不是给取消了么？
话说当年可以用公司其他古老员工PD的时候，有些老印选offer不看工资，看谁给的PD
老旧。
时光飞逝啊。

想什么呢。EB2一般要4-5年才能绿。2010的最快也要2014年了。

当然是有可能的。2007PD那批人吃了很多SO，所以才能4年绿。现在如果烙印EB3大量升
级，吃掉大部分SO，2010PD比2007PD时间长是非常有可能的。除非不按PD分配SO。

eb2是U, 岂不是eb2的排期落后于eb3 ? 这个从法律上讲没有问题吗

法律上讲，你还可以再File一个EB3的485，不过在2005年8月之后的PD，也是不会绿的。

看了原文关于EB3升级的描述，并没有提到这个数量是巨大的。只是说因为升级的原因
，并且这部分升级的人的日期早于之前公布的cutoff date（8/15/2007），同时因为
ROW名额也已经不足，所以造成“U”，换句话说，即便是08/15之前的PD（中印），也
没有名额了。
这其实是在解释为什么日期从8/15变成“u”。文中只是说这个数字存在，并且同其他
原因一起导致变成U。但是这个升级数字本身大不大，文章没有说明，也没有暗示

O的很多观点事后看是错的，但不代表当时的情况下这个结论是错的。根据板上有些人
得到的数据看，当时确实很低。而且高低都是相对概念，说收到的数量低，其实是相对
他假设的供给量而言的。当时3012风头正盛，如果通过的话，那个需求量确实很低。
今年Cutoff date能出现5/2010，很大程度是因为3012。因为3012规定一旦通过，要追
溯到2012FY年初生效。如果O当时不做些准备，比如多收中印建库存，多批中印以防到
时候处理不完造成浪费，他就不可能完成这些法律规定，那么他就有大麻烦。现在这个
法案基本死了，他就必须马上调整，不然ROW会给他大麻烦。
