2010年八月去一provider（A)做常规体检。刚开始给错了Insurance Info。二周后告
知不对，又重新提供了正确的信息。三周后 Followup，被告知还在处理，应该没问题
，如果有问题会通知。
去年年底（2011，12，29）日，又做体检，结果又告知有Balance没付，很惊讶。发现
2010年的帐单A根本就没Submit for claim. 很生气。对方又说会重新Claim。结果由于
超过90天期限，被我的保险公司UHC（United Health Care）拒付。现在A非常无赖直
接将帐单转给讨债公司。现在给A打了几次电话，对方态度非常恶劣，直接让我找Debt
Collector谈，然后就狠狠地挂断电话。
俺现在非常生气：过去一年多的时间，A根本就没及时地向我的保险公司Claim。而且
在这一年中，我没有收到任何通知。现在在没有通知我的情况下，居然直接将帐单转
给讨债公司。
有什么法子治治A 吗？太气人了！

在eb1b applicable statue里面说
(C) Published material in professional publications written by others about
the alien's work in the academic field. Such material shall include the
title, date, and author of the material, and any necessary translation;
这是横看像在说媒体报道，竖看像在说引用（特别是大段的），这个到底是在定义媒体
报道还是引用？duidiudiu在其著名的绿宝书中说到：“实际上EB1的法律原文[8 CFR
§204.5(i)(3)(i)(F)] 从来没提过引用这回事”。但是这个条款也只是说
professional publications，难道这个professional publications不包括学术文章？

先给保险公司发传真，无论篇幅多长，把事
情的来龙去脉都讲清楚，讲具体，重点说明，不是你的错误，是PROVIDER的错误。把讨
债公司的信件也发过去。
打电话也可以，但要记下接电话的人的名字和时间和回应，最好要一个reference
number.
BTW,所谓讨债公司不知道你指的是什么，很有可能是已经上报给信用局了，即
collection,你的不良信用可能已经被记录了。

媒体报道的要求如下：
Material published about you in major trade publications or other major
media. The material must concern your work in the field. Publications could
range from journals specific to your field, like The Journal of
Otolaryngology, to major newspapers, like The New York Times. You are not
limited to print; a story about you on "60 Minutes" might also fulfill this
requirement.

讨债公司可以上报到信用局
所以如果金额不多的话，建议还是忍了，就算你argue回来，也是费时费力
你这种情况，bill已经到讨债公司，就只能和讨债公司谈了
如果谈不拢，随时观察你的信用记录（花钱买那种monitor服务），如果上报了信息，
立刻和信用局联系，提供证据，remove不良记录

我贴的这个是通常律师们对媒体报道条款的理解
我的pl里也claim了，用的是两条Rxnews的报道，很弱

有没有给保险公司appeal试试？他家有那种formal appeal的程序，去myuhc.com 可以
找到相关信息，下载表格填好，attach任何你认为对你有利的证据，然后寄到指定地点
。必须是写信，保险公司的人告诉我说这种比打电话，传真要正式，她们会重新review的

一般就是你发的文章同期，有本领域牛人发一个comment文章评述你的工作，上面会说
见你的文章多少期多少页某人发的文章，而你的文章上也会给出见comment or news or
reviews

你这个是eb1a的。eb1b的简单点，就是profesional publications，包括学术期刊，专
业杂志等等。new york times在这里够呛。
lz的错误在于没有理解about the alien's work。整个的report是关于申请人自己的工
作成就。作为论文里的引用，即使是大段引用，那篇论文还是写得是作者的工作，不是
申请人的工作。所以肯定是不算的。
