大家好，我找到一不错的经纪人，但要签一份“Exclusive buyer agency agreement"
，这份合约中的下述几项我不懂或感觉不太舒服：
1. Exclusive Agent: Client agrees that during the term of this Agreement any
and all inquiries and/or negotiations on behalf of Client relating to the
acquisition of any Desired Property shall be through Buyer's agent.
这么说我不可以直接和卖方交涉了？
2. This agreement may be canceled only by the mutual consent of Client and
Buyer's Broker in writing.
我理解如果我中途决定不再用Agent他就干了活但拿不到钱了，可如果我要是不满意他
的服务呢？
3. If Client fails to require the Seller or Seller's Agent to pay the
Purchase Fee, Client agrees to pay the Purchase Fee.
(Agent收3% of Sales price)我只需要“Require”吗？
4. While Client will receive a credit against any amount owed pursuant to
this section for any amount paid on the Client's behalf to Buyer's Broker by
the Seller and/or the Listing Agent, any balance owed must be paid directly
to the Buyer's Broker by Client.
这段什么意思？
5. If the transaction does not close because of any fault on the part of
Client, the Purchase Fee or Fixed Fee shall NOT be waived and shall become
immediately due and payable by Client.
感觉没有明确定义“Fault”。
6. 我没有看到这样的条款，即如果交易不成则经纪人同意没有收入。
有没有专家解释一下？不知道是不是我多虑了，大家找经纪人时都签这样的合约吗？多

经纪人都想让你签。简单地说，你签了以后，你在一段时间内基本上无论什么方式买房
子，都要给这个经纪人钱。你想自己去看个Open house都不行。别惯他们毛病。另找人。

我遇到过很贱的broker，找我要broker fee几乎威胁的要我给钱。本小姐一分钱不给。
汲取教训后觉得以后要比他更贱用马甲！！怕啥

IF you are not happy, you don't have to sign this shit. IF you did, have
have to pay your agent anyway once you purchase a property within the valid
date of that contract.
Usually, seller will sign a listing agreement with broker/agent, otherwise
no service will be provided.
Many brokers/agents HOPE their client to sign a buyer-agency agreement to
simply protect their interest, so, just fuck with it.

千万别签，告诉你的agent，她要一定签这个，你就换人。现在是买方市场，谁签这种
一边倒的合同，。要是你找不到agent不签，就自己看房好了refin上房子和mlb是一样,
谈价还能把agent fee降下耒.

多谢大家的回复。十分对不起我没有说清楚，我不用付钱，有6% Commission fee。如
果我不用Buyer's Agent，则Seller's Agent全拿这6%；用了Buyer's Agent则他们对分。
我准备新建一House（Construct a new house），不懂的问题实在太多，才决定用Free
的Agent，但这个合约让我不太舒服。
这个合约是我们这个地区的Agent联合协会统一的表格，我面试过加一Agent，也给了我
他公司的几乎一样的表格。
我Google了一下"Buyer's Agent Exclusive Agreement"，才知道有人没有签这样的合
约，但在用了Buyer's Agent很长时间后在签合同时突然改用朋友或亲戚，只需让新的
Agent签个字就可拿3%。或者彻底不用Agent而自己和Seller签字但要求降价。这样
Buyer's Agent工作很长时间后一分钱也拿不到还没有办法。
站在Buyer's Agent的角度，我理解他们要求签这一合约的原因，我也没有打算做损害
他们利益的事情。
另一方面，我还读到只有在签了这样的合约后Buyer's Agent才会只效忠于我，否则也
没有什么约束他们做对我不利的事情（如和Seller's Agent有交易）。如果没有这样的
合约，在收入没有保障的情况下也很难想象Buyer's Agent会全心全意为我们做事。
现在犹豫之中。再次多谢大家的回帖。请大家多给些建议。

你的消息落后了，现在情况时如果有agent，最少要给1-1.5%的rebate，如果没有agent
，seller agent让出2.5%（6%的情况）或者2%(5%的情况)
跟你的buyer agent说，我不签着这种霸王条约，要么你按照我的条例帮我干，要么你
去吃屎，

靠，没看到最后一句话，“很难想象Buyer's Agent会全心全意为我们做事”，你在做
什么清秋大梦？你指望agent全心全意为你做事？
没有任何人全心全意为你做事，大家都在全心全意为自己做事。agent最大的动机就是
尽快（不是尽好）为你买到房子，显然你越是签了合同，他就会越push快，反正他知道
你别无选择。
天下所有的事情就是这样的，要么你自己下功夫，要么你就出高一点的价格，指望
agent为你做事，梦该醒了。
俺以前曾经草拟过一个条例，当agent拿出那张破纸让我签的时候，对agent说，你要么
吃屎，要么我请有license的人做appraisal，你的agent fee由你帮我讲下的价格提成
，结果agent对我说，你去吃屎，然后我对他说，要你何用，你才该吃屎。后来上
redfin，无agent，seller agent让了2.5%的commission。

It's normal to sign for one particular property the agent shows you, but not
"any Desired Property"

你买新房子，应该给你很多回扣。因为这个钱太好赚。我这里有agent能给80%的回扣。
当然，各个城市行情会差别很大。
签也可以，但是只能签某一个房子用他做agent，不能签几个月时间都是他做。

you probably can ask for 2% rebate, and then do not expect he do too much

好的agent不会push你，也不会要你尽快买高价的房子。他/她会帮你分析你的需要，有
时你头脑发热还会帮你降降温。只能说有人没碰到好的。
签不签这个表，就像婚姻一样，一方想保留脚踩多条船的可能，还要对方对你死心塌地
。lol。
你随时可以取消，again 就像婚姻一样，不合适可以离婚。：－）
BTW,agent never gets paid until you find your dream home.

Even if you do not hire a agent, the seller's agent may still charge you
full 6% fee.
obviously you can also negotiate with the seller's agent, so he only charges
4% or so.

你用任何buyer's agent，都不用你直接付钱吧。羊毛出在羊身上，你这个free agent
的说法太搞笑了。你要是签了约，以后不想用这个agent买房也要付他钱。

多谢大家的回复。实际上我是在自己找好了要建房的地点后才找的经纪人，主要是考虑
后面的室内设计、和Seller签合约、建房过程中的监督等头疼问题需要帮助。不知在我
的这种情况下还有没有必要找经纪人。
现在要去和Seller交定金to hold the lot。准备用这个经纪人但不签合约，或者像莫
位网友建议的只在"Desired Property"这一项只写这个lot。一旦对其服务不满则换个
lot建房而使这一合约成为废纸。还有一个可能的选择是改合约或签其它版本的合约如"
non-exclusive buyer agent aggreement"。不知大家有何建议。
还有一点可能我没有说清楚，合约是她在见面后给我的，但始终没有明确说要我签。我
在见面时问她我有没有“Obligation”时她说没有（可能她是指另一份“Disclosure
Regarding Real Estate Agency Relationships”）。我问她如不满是否可以中止时她
说可以。还有就是她在这样的经济情况下去年仍有骄人的销售业绩，这些也是我选择她
的原因。

用低的价钱买到房子。

I signed. But I signed because I want to put that rebate on paper to
guarantee I'll get the rebate. Also I signed to a version that I made lots
of change to the template terms. After I signed, buyer agent said only less
than 50% of buyer acutally sign this agreement, most agents don't even know
how to open the topic with client as it will drive them away. In the new
terms i put in the contract, I clearly stated we can fire our agent if we
are not happy with the service or don't feel like it. I'm still working with
this agent now. Can't say 100% happy, but the reason made us decide to use
him still stays and I'm so glad I made so many changes to the terms so we
still can backout any time if things became worse or not livable.

agent的主要作用是她的network可以帮你快速找到房子。
如果你自己建，他们作用不大。
如果有什么合同，可以找一个律师帮你看。
