第一次买房又是新建房,buider在addendum中加了这条,不知这个条例是不是正常,有
什么潜在不利之处?
Default remedies:
Time is of the essense. If buyer does not perform as required under this
contract and any contract addendum executed either currently with this
contract or hereater executed by buyer and seller (collectively,"contract")
or if buyer is otherwise in default hereuner then seller may elect to treat
the contract as cancelled, in which case all payments and things of value
received hereunder, including without limitation the earnest money, shall be
forfeited by buyer and retained on behalf of seller, and seller may recover
such damages as may be proper, or seller may elect to treat the contract as
being in full force and effect and seller shall have the right to specific
performance or damages, or both. Anything to the contrary herein
notwithstanding, in the event of any litigation or arbitration arising out
of this contract due to non-performance or default of any portion of this
contract on the part of buyer, the buyer shall pay all costs and expenses
incurred by seller in connection with said litigation or arbitration,
including reasonable attorney's fees. In the event that seller default
pursuant to this contract , buyer acknowledges and agrees the buyer shall
receive a full refund of the earnest money, in which event the parties shall
be released and relieved of any other liabilities or obligations hereunder.
Buyer expressly waives and disclaims any right to pursue seller for damages
, including consequential damages, arising out of a default by seller
hereuner.

不合理。就是在说他们想退出就退出,你想退出要让你赔死。这个你应该让你的律师帮
你据理力争。

你这个额外条款,让builder在和你的合同期间还可以找其他买家,如果价格更好,把
你甩掉都可以。不过这个可能性不算大,如果是上路的builder。
但是从反面就,你如果想退出,builder可以选择扣你押金还是告你到底。比如给你的
房价是40万,你押金是两万,后来你退出,builder后来只能把房子卖到37万,他们可
以让你赔3万的差价,以及相关的手续费。
其实,他们对于如果你default所要的赔偿,也算是行业标准,但是对于自己default所
要求你对他们的容忍,很少见。只是我上一次向builder买房时候合同不是这样的。当
然你自己如果无怨无悔则另当别论。
