各位前辈和大神，本人 EB2 PD 06/2014，有EB2 approved 的140。现在看到EB3一排
前进到08/2014。所以想让律师在4月份 concurent filing EB3 140和485。可是律师
的回复如下，说可以降级，但是不能concurrent filling。我本人不是很懂，但是看
论坛很多人都说可以concurrent filing，请大家帮我看一下律师的回复，然后帮我看
看为什么不能concurrent filing呢。
We can file a new I-140 to request a downgrade, however, we can't file the I
-140 and I-485 concurrently. We can't file concurrently because we have
already submitted your original Labor Certification with your last I-140
application. If you want to premium process your I-140 application, we would
have to file the I-140 application and then file the premium processing
request 30 days afterwards. This allows USCIS time to request your original
file (which has the original Labor Certification) from their records
department.

请问今天我们agent告诉我们seller非要参加inspection, 应该怎么解决呢？我已经让
我们得agent push back.但我们不想用她推荐的loan，她一天追着我们问这事，我们表
示在shopping around,她估计明显不太高兴，怕这事她不给使力。如果她不使力我们自
己有什么办法么？话说我们请她带着看了不到15个房子不到三个星期，就下了offer，
并且asking price 加了1000拿到的，我们这里不是加州高于asking price的事好几年
没有了，完全没有用她还价。这钱挣的够容易了，因为不想用她的推荐贷款，马上各种
不给力... 大家给出出主意

可以同时file 140和485，许多人都这样
但是同时pp可能会被拒，一般file后几星期后再pp比较好
你可以要求律师先同时file 140和485
等拿到receipt了再要求pp

有的buyer agent帮不上忙就算了，还要捣乱，真不知道他们有什么用。

感谢你的回复！我们就是问的律师要同时file 结果律师回了上面那段。我也不是很懂
难道不能同时file140和485是因为original perm was submitted with the first
140？有没有哪些原因会导致不能concurrent filing？还是就是有的律师不愿同时
file？

谢谢！我刚看了一下你说的那个文件能弱弱地问一下这个意思是说可以concurrent
file eb3年140和485 用eb2的 PD是么？我就是对这些都不太了解。。。怕自己理解的

看到美国人讨论说seller在场很不合适，原因和seller不应该参加house showing是一
样的，几乎所有的agents都说不建议自己的seller参加，还有很多inspector说seller
在场会使气氛很uncomfortable and stressful to inspector and buyer。我觉得主要
的顾虑是1）inspector虽说是为我们工作也应该保持独立性，但大家都是人，有时候还
是要顾及面子，一味的当着主人挑毛病肯定有所顾忌。2）本来这个时间应该是
inspector用来给我们解释问题以后的注意事项，如果seller跟着，他对每个人家提出
的问题都要解释甚至有时候还要argue，必然占用了我们学习的时间，觉得这个机会对
我们first time buyer还是很重要的。3）还有就是有什么重大问题需要renegociate的
，seller在场肯定要花很多inspector的时间来argue和我们有conflict of interest

再次问了律师公司只能先降级拿到eb3的140 approval notice才可以file485。。。
所以只好听律师的了多谢大家的回复

偶们是国际relocation，对情况完全不熟悉，relocation package里有一个就用了，以
后再买就不想用了...

我的也是这样，反复让律师concurrent filing，律师就是说不行。好在140 PP两周就
批了。
你的PD仍是第一次交485时的PD。

当然不应该在场，home inspector在检查的时候是很critical的，而且inspector当时
是很忙的，没有必要要和seller解释。

但好像也没有啥规定不让他们来啊，只能和他们商量？那他们要非来咋办呢？我可以让

这问题有什么难的么？当天你就把seller拦在门口，你也不用进去，说：let's talk...
顺便聊天一下，问问房子情况，看你怎么周旋了，反正只让inspector进去。

上次看见一个inspector的review，是一个seller写的，气鼓鼓地说inspector不够专业
，指出若干问题。她只好花了500刀找人来看，事后证明没有问题。

而且inspection是你买主花钱order的，你如果不欢迎他参加可以拒绝

直接了当地拒绝。这是你花钱请人，seller没有任何理由提这个要求。你的agent难道
没有帮你挡驾这种无理要求？我还从来没听说过seller要参加inspection的。

need time spent privately with the inspector during the process. 我们agent回
说 I will call the seller agent and express our concern. I would hope that
if the seller choose to stay during the inspection, they will keep to
themselves." 不知道这would hope怎么个work法，看来她也没啥折
Btw我另外在home inspection的选项里选了"not talk to the seller"...不知这有用
么...
我们是一定要跟着整个过程的，据说是个学习的好机会，到时候准备直接拉脸不让他们

you did the right thing. Tell your inspector not to talk to the teller about
any inspection results. You can find another place to talk, like a starbuck
, if the seller tries to join your conversation.

take it easy on house inspection. The inspector will pick many many problems
, but don't be distracted. ONLy care about big structural issues. Otherwise,
you will get emotional with negotiating with your seller and may lose a
good transaction on trivial repairs like broken light bulbs etc.

记得有大牛说要做房屋检查时要带着照相机、录音笔、手电筒什么的。

其实我觉得硬跟zhe也木关系，关键提前告诉inspector 要fair...
如果seller 在场，好处是他当场明白问题所在。。。也不用以后解释来解释去。

后来怎么样了？
我怀疑你们的沟通有问题 - Present不一定是全跟着，可能就是家里有人，没都离开
。哪里都没规定房主必须离家。我们的买主来房检，经纪也说我们可以呆在家里，
但我们正好有事，就走了，完了他们还发信问问题 - 如果房主在，问不就更方便了。
我们上周房检，房主就在，也好，说说话，问问邻居的情况。房检有个东西的年
头不清楚，她还翻出个receipt来给我们。
"not talk to the seller" 听起来很搞笑，太过较真了。“they will keep to
themselves” 的说法也怪怪的。

后来inspection前一天，agent说他们不会在家了。第二天他们的agent在，一进门就和
我们讲，不能用他们的dining table做任何paper work，不然划了都是她的错。我说没
问题，就在厨房和inspector把那些表都填了。我专门去看了看他们的餐桌，完全没看
出什么高级，一看是用了很多年那种。
话说这卖家妻子是个犹太女人，各种古怪（这是他们的agent自己说的）比如家里20多
年只用一辆车，从来不自己开车，出门从来都和老公一起老公开车。两人从不用手机。
最夸张的是，inspection那天，inspector抽了一张tissue用，吓得seller agent赶紧
把盒子藏起来，说不然seller又会对他blah blah. 我觉得她肯定也有点洁癖，不过好
处是屋子收拾的真干净，就像从来没人住过一样...
后来inspection结束，我们提了5条比较重要的修，结果女主人和seller agaent说，你
不要过来给我送来，we don't even wanna look at it...我的agent是美国人都很生气
说他们要respect the buyer。还说一年买卖房子都碰不到一个这样的。后来我们都过
了inspection contigency的期限他们也根本不回信。我们一气之下取消了约好的
appraisal，他们才回说给1000块钱，还写了巨长一封信说好像我们占了很大便宜（他
们提出要晚closing两周，期间我们不得不搬家找临时住处，vacation rental，我们这
里很有名的海边，夏天vacation rental都1500一周。）
这种难搞的人我们也不想纠缠了直接拿了钱不想再罗嗦了。
