最近收到Title Company送来的Commitment for Title Insurance, 发现Schedule C中
的Exceptions包括了卖家的一个Vendor's Lien retained in Deed 和两个 Deed of
Trust。我的理解是我的Title Insurance Policy将不Cover 这些 Deeds。如果将来万
一这些Deeds出问题,有可能影响我的房屋所有权吗?如何才能将这些条款去掉?是找
我的realtor, Loan officer还是律师帮忙?Item#6中的日期(dated December 30,
1899)是什么意思,是typo error吗?
另外,Schedule C 中还说:Recorded Deeds for the last 24 months are: None. 然
而,在 贷款银行 给 我们的 Property Valuation Documents 说到:This property
has transferred ownership more than once within two years from the valuation
date. 这两者是矛盾的吗?

SCHEDULE C
Your Policy will not cover loss, costs, attorneys' fees, and expenses
resulting from the following requirements that will appear as Exceptions in
Schedule B of the Policy, unless you dispose of these matters to our
satisfaction, before the date the Policy is issued:
5. Vendor's Lien retained in Deed dated XXX, 2008, under XX County Clerk's
File No(s). 2008XXXX, executed by XXX Dustin and XXX Dustin, Husband and
Wife to XXX Crowley and
XXX Crowley, Husband and Wife, securing one promissory note of even date
therewith in the principal amount of $200,000.00, payable to Mortgage
Electronic Registration Systems, Inc., acting solely as nominee for
XXX Mortgage Company, said note additionally secured by a Deed of
Trust of even date therewith to XXX Frizel , Trustee, and all terms,
conditions and stipulations contained therein, including any additional
indebtedness secured thereby, recorded under XX County Clerk's File No(s).
2008XXXX.
6. Deed of Trust dated December 30, 1899, filed for record under XX County
Clerk's File No(s). 2008XXXx, executed by XXX Crowley and XXX Crowley,
Husband and Wife to XXX Frizel, Trustee, and all terms, conditions and
stipulations contained therein, including any additional indebtedness
secured thereby, securing one promissory note of even date therewith in the
principal amount of $70,000.00, payable to the order of Mortgage Electronic
Registration Systems, Inc., acting solely as nominee for XXX Mortgage
Company.

Title Insurance 保的是在title search时没发现的lien,有些lien因为各种原因被漏
掉了,如果回来找,title insurance管。在title search时就发现了的lien,必须在
closing时保证是clean的,就是该付的帐都要付掉。已经发现的lien,必需证明都是
clean的才能close。title insurance不保close前已经发现的lien。

这俩应是现任房主的mortgage,共有俩个。没啥可担心的。这类问题该去问你的agent
or title officer.
