special education的法案是民权运动的结果，与race，gender，ethnicity几个问题一
样拿到美国人面前的。之后美国就右倾了，尽管在那个极右的年代，还是在里根和老布
什任内顺利通过了Americans with Disabilities Act (ADA)。这个法案，在执行上最
大的意义上是保证残疾人在公共场所的畅通。大家看到的各种自动门，各种ramps，都
是这个法律的结果。只要是公共场所，你都要做到或者限期做到，哪怕你是1800年的历
史性建筑。
2008年这个法案有有了新的amendment。其中重新仔细地定义了什么叫disabilities
定义如下：
"(A) a physical or mental impairment that substantially limits one or more
major life activities of such individual;
"(B) a record of such an impairment; or
"(C) being regarded as having such an impairment (as described in paragraph
(3)).
其中，major activities的定义如下：
In general.--For purposes of paragraph (1), major life activities include,
but are not limited to, caring for oneself, performing manual tasks, seeing,
hearing, eating, sleeping, walking, standing, lifting, bending, speaking,
breathing, learning, reading, concentrating, thinking, communicating, and
working.
"(B) Major bodily functions.--For purposes of paragraph (1), a major life
activity also includes the operation of a major bodily function, including
but not limited to, functions of the immune system, normal cell growth,
digestive, bowel, bladder, neurological, brain, respiratory, circulatory,
endocrine, and reproductive functions

大家可以看到，这个定义是非常非常宽泛，所以就有了公立学校的13% special needs
学生。其实在美国，无论你在红州还是兰州，对于special education的花费几乎是没
有异议的。就比如，德州在2012年重申，学区对于special ED的花费只能多余或等于上
年总额，每个学生人头(per student)花费只能多余或等于上年总和（请见http://www.tea.state.tx.us/index2.aspx?id=2147493439）。
总的来说，社会是逐步进步的，就比如再如何2steps forward，3steps back，美国也
不可能回到种族隔离的时候去。最极端的保守势力也要向人们的需要低头。某著名ID提
出了一个solution，上私立。我还帮她加上一条，搬到烂区去。你住在好区，就算上私
立，花钱在special education上的一分不少。
说来说去，这是一个左右站位的问题。右边的人，不愿意承认，愿意把这个问题归结到
滥用不滥用的问题，不愿意承认他们没有评判滥用或不滥用的credential,同时还自己
赋予自己watch dog的role，经管他们只能提出一些很可笑的证据来证明所谓的滥用。
你可以批评我只顾政治正确，我也想提醒某些家长，最好keep these ideas to
yourselves，无论蓝红州，没有人会买你的帐。不信你可以发动一个campaign。希望你
不要自取其辱。
