现实条件，真心上来请教，H1b准备海归，请问
1.公司两个星期notice之后，我必须几天内离境呢？
2.如果以后有机会再回美国工作，h1b需不需要也要到10.1生效还是怎么弄？能接上直
接用吗？
3.401k怎么办？

我是辞职海归，问了律师，一年之内h1b可以接上，一年以后就难说了。离境的话，说
法不一，估计一个月内没有问题。

1. reasonably short time, if you plan to get a US visa within one year or 2.
If over 180 days you must be subject to 3 years bar. But even less than 180
days, VO at US consulate can deny you if you stay a few months (<6) without
status.
2. if out of US >1 but < 6 years, you have a choice. Either to use a new one
(effective 10-1) with new 6 years limit, or use your first H1 for its
remaining years.
3. It's still yours in the same US bank/financial institute, subject to the
same rule as if you were in USA.

这个H1B身份可以维持多久？是不是只要还在公司的pay roll里就算h1b？

1.从最后一天工作开始算，应该是2周的时间内离境，跟你什么时候给公司notice没关
系，你在payroll的最后一个天开始算。
2.任何时候回美，都可以不用占名额用以前H1b剩下的时间。如果离境一年以上（中间
不能以任何身份赴美），可重新申请新的占名额的H1b，如果是在10.1之前申请的，则
要到10.1生效，如果10.1之后申请的，马上就能生效，好处是6年从头开始算。
