朋友A 在一家consulting 公司 G 做 independent contractor (1099 FORM) , 客户
是 C 公司。
最近朋友拿到了 这家 C 公司的FULLTIME OFFER, 签了OFFER后, 朋友给 G公司2周的
NOTICE, G 公司没有任何反应;
然而朋友开始工作后, G 公司却说以前签有 agreement 说因为 C 是 G 的客户, 在没
有和 G 公司明确确认的前提下是不可以先接受 C 公司的OFFER , 要找律师告这位朋友。
朋友的情况是:
1. 公民
2. 朋友手里只有以前和 G 公司签的 OFFER LETTER, 并没有其他的agreement ,当时
的OFFER LETTER是这样说的, 但没有不可以接受客户OFFER的条款:
OUR COMPANY ADHERES TO A POLICY OF EMPLOYMENT-AT-WILL, WHICH ALLOWS EITHER
PARTY TO TERMINATE THE EMPLOYMENT RELATIONSHIP AT ANY TIME, FOR ANY REASON,
WITH OR WITHOUT CAUSE OR NOTICE.
This is a time-bound W2 Hourly employment with monthly payroll with Net 15 .
It is back-to-back tied with our client project and automatically terminates
on the date of our client engagement termination.
It carries no benefits and no rights to continued employment.
Please make note that our client contract stipulates a two week advance
notice required by either party to terminate the agreement.
You can start only after satisfactory background and drug screening reports.
