次利用与职务有关的非公开资料从事内线交易,5日获判五年徒刑。他从内线交易获得

感内线资料,从制药业股票市场获得不法利益。他多年来利用在FDA的职务在股市轻易

资料大胆谋利。他不知道调查人员早就利用先进科技工具发掘和追踪犯罪行为。我们将

58岁的梁诚一去年10月18日承认触犯一款证券诈欺罪和一款提供不实证词的罪名,
5日由马里兰地区联邦法官判刑。
根据法庭文件,梁诚一在1996年获聘为FDA新药品质评估处化学家,他的工作使他
能够接触FDA用密码保护的新药申请程序内部追踪系统,其中有许多关于提出实验性药
物请FDA审查的制药公司不公开的资料。
住在马里兰州葛塞斯堡的梁诚一在认罪协议中,承认大约从2006年7月到2011年3月
,利用这个系统和其他来源的非公开资料,买卖制药公司股票,并利用儿子和其他亲友

A Gaithersburg man and former chemist with the Food and Drug Administration
was sentenced to five years in prison Monday for his role in a $3.8 million
insider trading scheme.
Cheng Yi Liang, 58, pleaded guilty in October in U.S. District Court to
committing securities fraud and making a false statement. Liang was facing
up to 25 years in prison, eight years supervised release and a fine of over
$5 million but, because he had no prior offenses, the guidelines were set
closer to five years, said U.S. Department of Justice spokeswoman Marcia
Murphy.
“Actually five years was a very good sentence because he doesn’t have any
prior offenses,” she said. “Anytime we get a sentence that was in the
guidelines we’re pretty happy.”
Liang was ordered to forfeit $3.7 million, of which the government has
seized $1 million in the form of Liang’s bank accounts, Murphy said. Liang
also forfeited two properties in Montgomery County, a house and a
condominium, that will be sold by the government toward paying back the
remaining $2.7 million in forfeiture, Murphy said.
Assistant Federal Public Defender Joseph L. Evans, who represented Liang at
sentencing, had asked Chief District Judge Deborah K. Chasanow to sentence
Liang to 30 months — about two and a half years — in prison, namely
because Liang had already begun to pay back his forfeiture and did not have
a prior criminal record.
“Chief Judge Chasanow takes these matters very seriously and her judgment
is something that I always respect, so while I obviously wish the sentence
would have been closer to what I had requested I have no reason to criticize
her decision,” Evans said of Chasanow’s sentence.
Both Liang and his son, 26-year-old Andrew Liang, were arrested in March
2011 after authorities discovered Cheng Yi Liang, an FDA employee since 1996
, had used his access to the administration’s internal tracking system for
new drug applications to tell Andrew Liang when a new drug was about to be
approved, according to court documents.
Andrew Liang would then buy stock in the appropriate pharmaceutical company,
ultimately netting more than $3 million in profits based on non-public
stock information, the documents state.
Charges against Andrew Liang of conspiracy to commit securities fraud,
securities fraud and wire fraud were dropped last month.
However, FBI investigators found more than 600 images of child pornography
on Andrew Liang’s laptop computer after they seized it in the fraud
investigation. He pleaded guilty Sept. 22 to one count of child pornography
and was ultimately sentenced to one year in prison followed by five years
supervised release according to his sentencing judgement filed Dec. 8.
