目前opt 2/23过期，现在公司正在帮忙办h1b，但是材料还没寄出。怕赶不上2011财年
的名额。
刚刚看了一下uscis网上说可以有f1-》h1b cap gap.
说是只要在opt过期之后的60天之前申请了h1b，原有的学生身份就可以继续保持。
那岂不是意味着即使我赶不上2011财年的h1b,但是四月一号我递交了申请。我仍然可以
保持f1身份直到10/1/2011。我仍然能用f1工作。
但是2/23-4/1能不能工作呢？

最近被实验室的senior博后搞的不行。两个人联合起来，就想把我逼走。本来老板要给
我涨薪，也被他们搅和黄了。老子想穿了，不干这博后了。想试试工业界的职位。我本
人搞发酵，微生物，发酵产品的，最近投了不少简历，虽然都没有回音，但是说什么都
要跳出这个烂实验室。

不能工作，4/1 - 10/1也不能工作，要等到10/1生效
所以你还是赶快催公司快点寄材料出去，好赶得上今年的名额

发酵好找工作啊。工业界的工作都要投一段时间才有回音，继续投呗。
多看看craigslist上面贴出来的生物工作也是一条途径。

你要找自身原因。从你的帖子看，你思路不太清晰或者表达有问题。首先，据你自
己说，老博后对你不好，没提老板如何，所以估计老板还马马虎虎。这样的话，就
下结论说是烂实验室不太合乎常理。其次，由于老博后对你不好，因此下结论是由于
做博后的缘故，希望通过到工业界来改变这种状态。逻辑上很不通顺。到哪都有对你
不好的人，尤其是如果你思路不清，表达不顺的话。即使你到了工业界，照样有人
排挤你，比在科研单位只会更严重。当然，我不是说在学校当博后是什么好差使，
我说的是你的思路，表达方面的问题。在学校当博后的确不是什么好差使，因为工资
低，不稳定。你的帖子里因果关系混乱，逻辑不清，但愿你平时不是这样。如果平
时也是这样的话，就不难想像别人为什么有机会排挤你了。至少，那时因为你说不过
人家，由于你逻辑混乱，说着说着就把本来你有理的事变成了你没理了。

越来越急了。看来h1b名额在这周肯定要用光了。
公司规模比较大，他们一切都相信律师的。
而我问了律师一些问题之后，律师有点不耐烦了，让我有问题直接问公司的hr。
问题是hr 啥都不懂。
现在也不知道我的h1b申请进行的什么程度了。不知道lca批了没。唉。
上次去跟hr谈，hr说律师说最晚可以让我2月中旬入职。hr对律师很有信心，认为一定
可以帮我拿到
h1b.
劝公司加入e-verify，hr也没考虑，还是听律师的，在帮我办h1b。
现在都不知道自己该做什么，该不该再催催他们。上周来往了很多邮件，怕大家都烦了
。这种大公司
真麻烦，还不如自己找的律师，可以时刻盯着，知道进度。

from my understanding, the cap gap is applied when
1) opt expires between 4/1 - 10/1
2) h1b petition is pending
in this case, you could work.
since you opt expires before 4/1, i don't think you are allowed to work. but
as you h1b is pending, you could maintain your legal status until h1b
approved.

yeah, you are right.
but the problem is i am not sure the lawyer can get a h1b cap for me
before
2011's h1b are used out.
i don't know whether they filed the petition or not.

可能只能像前几年没有cap gap的时候找些可以马上办CPT的学校
