I have I-140 approved, PD date is 5/23/11
My perm case was originally EB2, but it was rejected due to DOL shut down
when it was filed 10/1. So very likely it will exceed the 180 day limit for
recruitment. My company has to redo the recruitment. should I ask them to
change posting and do EB3?

I'm in similar situation. PD 6/9/2011 EB2 from previous job. HR and
attorney at new job had decided to file PERM under EB2. I spoke with the
attorney today after VB coming out and she said EB2 is still better choice
because she didn't believe EB3 would advance further. I told her i'm willing
to take the risk then she said shes going to check with HR about it.

EB3还有一个顾虑是会不会有很多老美来,导致过不了
