Sec. 2304. World-wide levels and recapture of unused immigrant visas
UNUSED VISAS.—The number computed under this paragraph is the difference,
if any, between—
(A) the sum of the worldwide levels established under paragraph (1) for
fiscal years 1992 through and including 2013;
and
(B) the number of visas actually issued under section 203(b) during such
fiscal years.
应该可以清空backlog了，还在排队的人快发包子吧。

记得以前说过了，这个数字其实没多少。

就以FY2001-2005年为例吧
FY EB实际用量
2001 186,536
2002 171,583
2003 83,020
2004 157,107
2005 242,293
总和 840,539
名额 140,000*5=700,000
这5年多批出了一年的量。请问哪里来的350000 unused visas?
之所以这几年能多批，是因为AC21 Sec 106(d)已经recapture一次了。之后的年份也基
本没有比配额少太多，如果不是超出的话。

这里面是不是包括FB没用完转给EB的？
这个unused visa可能也包括FB没用完的。

你去看楼主贴的条文，所谓recapture就是直接相加再相减，不管当年用的名额是怎么
来的。

1992年到2000年的数据呢？
AC21 106 （d） recapture的是99年-00年的名额，没有涉及99年以前的
(d) RECAPTURE OF UNUSED EMPLOYMENT-BASED IMMIGRANT VISAS-
(1) IN GENERAL- Notwithstanding any other provision of law, the number of
employment-based visas (as defined in paragraph (3)) made available for a
fiscal year (beginning with fiscal year 2001) shall be increased by the
number described in paragraph (2). Visas made available under this
subsection shall only be available in a fiscal year to employment-based
immigrants under paragraph (1), (2), or (3) of section 203(b) of the
Immigration and Nationality Act.
(2) NUMBER AVAILABLE-
(A) IN GENERAL- Subject to subparagraph (B), the number described it this
paragraph is the difference between the number of employment-based visas
that were made available in fiscal years 1999 and 2000 and the number of
such visas that were actually used in such fiscal years.
(B) REDUCTION- The number described in subparagraph (A) shall be reduced,
for each fiscal year after fiscal year 2001, by the cumulative number of
immigrant visas actually used under paragraph (1) for previous fiscal years.
(C) CONSTRUCTION- Nothing in this paragraph shall be construed as affecting
the application of section 201(c)(3)(C) of the Immigration and Nationality
Act (8 U.S.C. 1151(c)(3)(C)).
(3) EMPLOYMENT-BASED VISAS DEFINED- For purposes of this subsection, the
term “employment-based visa” means an immigrant visa which is issued
pursuant to the numerical limitation under section 203(b) of the Immigration
and Nationality Act (8 U.S.C. 1153(b)).
