At present, EB-3 (employment-based) visas for China have a current priority
date of October 1, 2011. EB-2 visas for China have a priority date of
November 8, 2008. It is now clear that is possible to file a second I-140
in the EB-3 employment-based category based upon the prior approved PERM
without jeopardizing the I-140 filed under EB-2. It is not certain how long
EB-3 will maintain a processing date of October 1, 2011. The second I-140
can be filed as a stand-alone I-140 or in conjunction with an adjustment of
status.
For convenience, attached is a detailed memorandum that outlines the
available options.
I do recommend we proceed and file a second I-140 petition at a minimum.
