11/21/2014: Our Message to Republican Leaders in the House and the Senate to
Start Piecemeal Immigration Reform Legislations in the First Month of
Republican Congress
We admire the President Obama for his courage to take action, absent
legislative actions by Republicans in the Congress. It is time for the
Republican legislative leaders to collect themselves rather than being
dictated by emotions and to start working on piecemeal immigration reform
legislations one at a time as they have all along advocated. The President
has taken a careful and conservative strategy in working out the executive
actions against the potential upcoming lawsuits by the political opponents.
One good illustration is foreign worker immigration reforms which have been
heavily advocated by the businesses and eventually left out in the executive
actions. We are talking about recapture of unused immigrant visa numbers
and taking out family members from the annual immigrant visa numerical limit
. Under the current immigration statutes, there is a room for diffeent
interpretation as to availability of these two options without legislation.
Such different interpretations have yet to be tested and settled by the
Judiciary at the highest level. It appears that the President left out these
two options for the reason that the practical result of such options would
lead to adding new immigrant visa numbers beyond the annual limit under the
statute and he did not want to give a weapon for the Republican opponents to
challenge his entire executive actions before the courts using this weapon.
Report indicates that Obama immigration execute action legal team tried to
work out a bullet proof and the most conservative plans with their
anticipation that the opponents will bring lawsuits. The resuilt turns out
to be his limited actions for reform of employment-based immigration reform.
Republican Congress should take up these employment-based immigration
reforms legislatively to bring a balance in overall immigration reform. It
is do-able action for the Republicans in that indeed the Republican
legislators have introduced in the Congress such bills in piecemeal bill
formats in the past and failed for the two reasons: One was failure of the
Democratic Senate to take it up on the floor because the Senate wanted "
comprehensive" reform approach. The other reason was the bill sponsors had
attached poison pills to keep balance and not to increase visa numbers. The
Republicans attached many different poison pills, but the most notorious
pill was elimination of diversity immigration system (immigration lottery)
to compensate for increase of visa numbers through recapture of unused visa
numbers or taking out family members from the annual immigrant limit.
Inasmuch as the Republicans cannot come out of such shell putting a firm cap
of visa numbers for immigration, Republicans will never be able to achieve
any immigration reform. They will be labelled not just as opponents of their
alleged immigrant amnesty but also "anti-immigration" political forces.
Unless they take a bold action to come out of the current shell, they will
definitely pay hefty price in the upcoming 2016 Presidential election. Come
to think of it.
