USCIS records indicate that Dr. xxx’s Form I-485 case is employment based
and dependent on an approved Form I-140 petition. Your constituent’s has a
second Form I-140 petition that was approved on September 3, 2014 and
provides for a third preference Immigrant worker visa from China with a
priority date of January 24, 2013. The March 2015 Visa Bulletin allocates
third preference immigrant worker visas from China with a priority date
prior to June 1, 2013. We have forwarded your concerns to the I-485
supervisor to review and prepare your constituent’s file to be assigned to
an officer. Please note that derivative family cases are generally
adjudicated at the same time as the primary case. We are unable to grant
requests for expedited processing in employment-based Form I-485 cases."
