我现在在用OPT做contractor的工作，5月底工作结束，我的OPT到8月底。想file OPT
extension，但是需要自己是e－
verify 公司的employee。不知道可不可以以老公的名义申请公司，我做employee，然
后上网e－verify。老公是H1B。不
知道申请extension的时候会不会有问题，因为我和老公的地址是一样的。因为可能8月
后开始另外一个工作，但是也是
contractor，所以需要自己挂名个公司。请达人看看可行不？

H1B只能为sponsor他H1B的公司工作，自己不能开公司的

H1b可以自己开公司，但是他不能工作，另外，如果想借这个公司为你申请H签证很
困难，因为你达不到劳工部的要求。

劳工部的要求估计比较严格，否则大家自己给自己和和h1b

No. If a company has less than 25 employees, the company needs to show that
the employer is NOT a relative to the foreigner the company intended to hire
. If your case, the employer is your husband so no chance.

你可以自己办公司，然后申请opt延期，有人这么办的。

1. you are on the wrong board.
2. People on this BBS tend to do thing the safe way. They won't understand
others who are in desperate situations.
3. You are smart enough to do whatever you want. Do a little search about e-
verify.
4. If you succeed, don't tell everybody, particularly people on this BBS.
When the size of people doing similar stuff grows bigger, you might be in
trouble.
