Dear all:
my friend worked in university.
However, six months ago, the dean told him that his position will be expired
in end of May, 2011.
Therefore, he started looking for job. However, He try to find a job in a
company.
As you know, He got the current H1B through the university which there is no
cap for H1B. Now, he will start his job in company, which has cap for H1b.
Do you think that he is still OK for H1B transfer or he needs to apply for
another H1B?
He is so frustrated and think about going back to China for business.

currently USCIS is using a ridiculous memo to interpret work authorization
of non-cap H1 to cap H1 transfer, that is, you can work for the cap H1 job
during the PENDING time of H1 transfer, but once the H1 transfer is approved
, you can no longer work and have to wait until the cap H1 start date (Oct 1
, 2011) to work.
In this spirit, you will want the H1 pending as long as possible.
