苦等niw 140 能批好延h1b，但现在140还没结果，无法延h1b,h1b已经过期, 无法工作
。
工作gap 太久了，老板今天打电话问情况。很焦急！
现在转h4，但h4也还在pending 中，也不能申请h4 EAD。想如果去加拿大或周围的国
家直接签h4 签证回来，再申请h4 EAD, 不知这样行不行？ h4签证可以去加拿大或巴
哈马签吗？
请高人指点啊！！！

Bear with me if I had misinterpreted your questions. You had a H1B before,
right? If you could extend H1B based on an approved-NIW, why do you switch
to H4?
Based on online research: if you had already filed H1B extension before the
expiration date of your previous H1B, you should be able to work in H1B
extension PENDING status for 240 days, if your employment situation has not
changed. But, during that 240 days, traveling abroad is NOT recommended. 240
days usually are sufficient time for you to get renewed H1B.
Is your current status H1B-exention pending or something else?

我的140 还没批。已经快8个月了！
现在的身份是h4 pending. h4 现在也是处理的很慢。批不下来就不能申 h4 ead ( 家
属的 140 已批准）。
不能在等了，想尽快直接出境签 h4 的签证，再审 ead.

mbn, your spouse's is not in H1B extension pending status, right? Were you
in the process of switching your status from (expiring but not expired H1B)
to H4? I asked these question because your current status means a lot for
your planned visa application at consulate overseas.

谢谢！
家属现在是h1b, 我的h1b 已经过期了，申请境内转h4, 但目前h4处理太慢了。想直接
境外签h4签证（去周边国家）。不知可行否。

同学，人家问你现在身份，你既然说h4 pending，那就是说你现在不是h4。对吗？h4
pending不是身份
如果你的上一个签证，不是h4，那就只能回original签证，我记得我在哪儿看到过这个
规定，在第三国只能签和最近一次一样的签证，比如，本来是F1，但是现在是h1b身份
，第一次签h1b必须回原籍签

谢谢您的解释。这正是我的担忧!
我现在的状态是h4pending.因为我看到过别人在填某个表格时使用的。当时他的h4也还
没批下来。
现在我的身份应该是AOS,对吧?就是说这种情况必须回国签。

很慢的原因是不那个crush呀？估计不管你哪儿签，速度一样

谢谢啊！
境内转h4只是获得h4 status, 只是获得批准的i-797, 不是签证。签证必须出境才能获
的。问题是现在批准797很慢，无法申请h4 ead. 如果出境直接签证，回来就可以申了。
您的连接我也看到了。问题是我是从h1b 要转签h4,是不是也是同一个category? 都是h
签证？
请再指点！
