我现在在一家non profit公司工作了2年多，目前的I797在2013年底到期。目前找到了
一家profit公司的工作，新公司已经在6月重新申请了h1b，目前已经收到了receipt。
但是公司希望我7月去上班，然后再h1b被批准之后停止上班，然后在10月1日再上班。
公司明白这个gap而且能够接受。但是我有些疑问：
1. 这样的办法是否真的可行。公司的律师是说没有问题。我考虑是依据那个移民局的
信。
2. 如果h1b在10月1日之前被批准了（很有可能在8月或者9月被批准），我就需要停止
工作。公司律师说不需要离开美国，但是不离开美国我不就是out of status了么？看
到Murthy上的说法是需要离开美国。这个不知道有没有人有同样的经验。
如果有人有类似的经验，请分享一下。非常感谢！

另外，你这个7月上班应该是illegal的吧，毕竟是不同的h1b...

移民局主管的回复（同意律师的看法）：
I agree that a result in which an alien with a pending petition is in a
better situation than one with an approved petition makes no sense. A
reading of 214(n) such as the one you suggest that continues employment
authorization until H-1B status is available is a logical one, and USCIS
will explore this position in future rulemaking.
