刚来米国,是research associate in Bio. 在U of Michigan. 下飞机发现了U of
Washington at Seattle Law School 的JD offer. 来之前没想过那末多,来了才发现米
国的麻烦真多。我已经将offer延期到明年秋天了,本想今年年底就去seattle,一来熟悉
环境,二来争取找个patent law firm作technical assistant. 看了大家的讨论发现很不
现实。我是H1-B,要换地方不知会不会有问题。就算明年真的进UW,身份也是个很大的问题
。听大家说很难拿到绿卡,这样就不能考patent registration.不知bar test 能考吗?
大家给点意见和建议吧,快要愁死了。我现在的老板很好,什莫忙都会帮的。先谢了。

If I were you, I would stay at UM, start the GC application immediately. I
assume you already have a bio PhD from China. Your US postdoc experience will
be very valuable and compensate for the inadequacy of a Chinese degree. After
you get the GC, look for a patent agent job, and re-apply to law school.

thanks so much. it is really nice to see a reply.
not that. i am a master only, got from Singapore. :p. do you think i will have
a chance to apply GC before i go to Law School? say, can i at least get a LC
before i go to law school? i have been working in a biotech company for 2 y
before i came here. will it help on GC application? my boss will help me for
sure. my LSAT score is low, and i dont really understand that UW could take
me. so, it is like my only chance to get in a not-bad Law School.

You need to consult an immigration lawyer to figure out the procedures. I
can't tell you if and when you will get a GC/LC, nobody can. But you have to
try (EB11, NIW, and LC), and be prepared for the worst scenario. If you want
to do IP prosecution, a bio PhD is almost a must now. There are other ways
around, such as working for USPTO, or going into IP litigation. But these
alternatives are unpredictable.
Right now you should really focus on GC application, because it takes a lot of
time a

it is so nice of you to tell me so many things. i have been frustrated for
almost a week, and it seems that it is just a beginning. i will try all my
best for it. if for the worst, i can still stay as a H1-B in bio area.
just a last small quesiton, could i take the bar exam as a F1 student, or i
also need a GC? many thanks.

I noticed that you always encourage people to
find a patent agent job before going to law school.
It sounds reasonable. But is it really practical?
I am just curious about the possibility for most of
bio guys to find a patent agent job. To me, it seems
even harder to find a patent agent job than a job in
the industry.But how many bio people will actually
think about going to law school if they can land a
decent job in the industry after getting their PhDs.

I am not sure what your career goal is exactly. If you just want to stay in
U.S. and work as a patent lawyer in a firm, why not try part-time J.D.. You
can apply for a law school near UM. I know a guy, who also majors in Bio,
study at Wayne State part time while working in Pfizer. And he already got a
summer intern in a Detroit firm this summer. Of course, if your future goal is
to come back to China. Wayne might not be that prestigeous as UW.
Anyway, it really depends on your plan for future.

No you cannot take the patent bar with an F1. You can take the patent bar
only if you have a GC or an H1B from a law firm practicing patent law.

Finding a patent agent job significantly lowers the risk of the entire plan.
With experience as a patent agent, you can be sure to have a paying 1L and 2L
summer job (which means you won't be in deep debt after JD), and can simply
short-circuit the entire OCI rat race. Also, this counts as your prior
law-related work experience and increases your chance of getting into a decent
law school.
Second, finding a patent agent job gives you a reasonable estimate of the
competition in the job market --
