我的女朋友在一家珠宝店看中一颗戒子, 老板拿计算器在她和她的一个同行朋友面前算了
三次,告诉她们说价格是$3100, 但老板要求现金支付. 我的女朋友没有这么多现金,说立
即去银行去取, 一个小时就回来. 她把她钱包里仅有的$100先给了老板,老板开了一张"
LAY AWAY"票据,上有公司的TITLE,商品名称及价格($3100), 以及我的女朋友的支付记录(
说已付$100). 等我的女朋友取款回来,老板说对不起,刚才价格算错了,应该是$4100. 我
的女朋友表示不可接受,认为价格已定了她才去取款的,这是违法的行为. 店老板一口咬定
这是一个MISTAKE,说谁不犯MISTAKE啊. 老板坚持价格为$4100,也表示即使上法庭也不在
乎. 请问这样可以告店老板吗? 如果要告,胜算大吗? 如果败诉,我们有什么损失呢? 应
该去那种法庭呢? 请多多指教! 谢谢.

Do you think I can sue him? He did issue a document of "lay away form" on
which my girlfriend signed her name. Please suggest me what to do. Thanks.

Last question first. If you lose, you pay fees for your own lawyer (in
addition to your court costs, such as filing fee to commence a new case), but
not their lawyer. (Appeal wqill be another matter. Let's not get ahead of
ourselves--do the case at the TRIAL court first.)
I thought about your matter while sleeping. You did not spell out many key
things. Maybe it was because it was really your girlfriend, not you, who was
there (then it is none of your business, ask her to come here to pose the

At $3100, how much lower is it than the "reserve" price in her mind? Suppose
she thinks the ring is worth at most $3500, her loss is $400 because the
seller backed out.
My question to you: is $400 worth going to court (many lawyers charge that
much for one hour)? People sometimes get too caught up in the law. Use some
common sense. The guy made a mistake, cut him some slack. It's not worth it
to go to court and saw a lawyer over a few hundred bux.

know. However, since Ilikeit does not come here anymore, there is no point
discussing it further. Except that I hope to remind you both that a fruad will
trump contract concluded in a mistake. See Restatement of Contract.The money
is not the point. I am not a lawyer, but a pro se litigant. So I need not pay
a lawyer. Moreover, the cost can be covered if one can make a class action ut
