可以回国等, you need file I-824, the processing time is longer than I-485. In Guangzhou, more than 50% of EB2, EB3 cases will be denied after consular interview, if your case denied, you can pay $720/person Visa application fee again and 2nd time, 3rd time interview. It is a high risk.

I understand what shmu has said. But following are my points: 1. whether you should update USCIS your movement to China? For example, you can describe your remote as a temporary project assignment in China. It could be as short as several weeks at starting point but as most of projects you never know how long it could be at the end. It's like: should you update USCIS every time you travel to China on business purpose? I dont think so. 2. Regardless, is there a risk of not telling USCIS you are in China? 3. If there are, what is the risk? I don't have any idea about question 2 and 3. But will appreciate if anyone can share a light. Thanks!
One of my Russian colleagues worked "remotely" from Russia for about 2 months before. He did it not only once, but 2-3 times in 2 years. As far as I know, he didn't notify USCIS about this and he got his green card in '09. Another question I have is that whether the applicant should maintain H1B status while work remotely in home country waiting to submit 485.
assignment ? anyone

dude, the answer is so obvious: YES, you need keep H1B. Since the whole point is to keep your case as close as you are working here, with valid working visa and with legal status, regardless you are traveling domestically or internationally. Follow all instructions as you are working here, and enjoy the convenience in China. But if possible, consult an immigration lawyer before taking action. Don't take suggestions here too seriously, as we are not professional, and we are biased towards ourselves. Good luck and keep me posted. I am in the same situation. Will shoot you an email with my personal contact through this website. Let's talk offline.
