If you are holding H1b visa, according to law, you are considered as resident for tax purposes. In fact, you can even start a company if you want with H1b visa. I think the problem is not here.Even if it is a problem, you can ask your resident friend to co-found a company -- which will cause you hundreds of dollars. But you should anyway.

My old knowledge (not sure if it still applies today): as H-1B holder, you can open a company, or own shares of a company, but you can't get paid from your company. You can pay your employees (excluding yourself), purchase assets for the company, etc. For profits, you can keep it as retained earning (can't distribute to yourself as dividend). In another word, you can spend money, but can't get paid.

When I said "you can spend money, but can't get paid", it was in the context of a company, started by you as sole partner, or by you and other people as joint partnership. My two cents on online selling: strinctly speaking, I don't think it's legal to sell on ebay with H-1B status. I guess many H-1 holders still do it without trouble just because the amount is small (ebay doesn't bother to report to IRS if a seller's annual revenue is less than $20k). When you sell goods on ebay or Apple Store, even you are acting as an individual rather than a business entity, as long as your purpose is to make profit, I think it's still considered self-employment. Well, I guess this is a gray area - 民不举,官不究。 You'd better check with H-1 holders who have real experience on ebay or Apple Store. Above is my speculation based on my old knowledge. Good luck!
