2011短期亏6000，长期亏2000，抵消3000块2011收入后，carry over的长短期损失各是
多少？按比例摊，还是说合并损失5000，不分长短一起带入2012？

I 140 approve notice 上last name 写错了.
跟律师打过很多次电话,律师也说寄过了amendament, 移民局数据库里已经改正了相关
信息, 但是不会重新发notice.说是没有关系.
还是很担心,怕什么关键时候出什么要蛾子.
所以到版上来问问,有没有关系.

俩人各说各话，还各有一帮支持者。这已经扯了3个月了，再扯下去没头了。我看各人
按自己的方案做一套然后测一下拿数据来说事儿。实在不行有了数据可以让大伙来投个
票。网上不就挣得是个面子是个口碑吗？有个结果出来这事儿也就算有个头了。要不然
没完没了。

because both were loss in 2011, so just combine them together. If in 2011
one is gain and one is loss, you need to go through work sheets (applying
different rates) to determine 2011 loss/gain amount (and which should be
done in spring 2012, now is too late).
after 2011 loss is determined, the negative balance (after deducting 3000)
will be carry over to 2012.

isn't LT loss for offset of LT gain, ST loss for ST gain?
if my loss in 2011 doesn't distinguish ST and LT, how could i do the
separated offset?

because in your case both 2011 LT and 2011 ST are loss, so it's simple, just
add them together. Loss is loss, no tax is evaluated. If both are gain,
different tax rates are evaluated, not just simply add them up as your gain.
If you have gain in one and loss in the other, you need even more
calculations, follow the worksheet.

i still don't get it.
say if in 2010 i have both LT loss x and ST loss y. 3k cap loss was deducted
in 2010 tax form. so my carryover is x + y - 3k, assuming x + y > 3k.
in 2011 i have both LT gain a and ST gain b. how can i calculate my cap gain
in 2011 now?

i see you are a little frustrated now, so I cannot help jumping in.
use the gain/loss work sheet in schedule d. you will separate the LT loss
and ST loss again, so you can use the separated numbers to fill in your
2011 schedule d.
i agree that this is stupid.
