It depends on how you want to use it. Under most circumstances that I can
think of, I believe it's legal.

I despise liars.
I am not your attorney and what I say may not apply to your case.
If someone says something to me voluntarily, and later denies ever saying it
, but I have told other people he said that something, can I take my mp3
player that happened to be recording when he said it to prove that I am not
a liar? Sure. I would think so.

I suspect what you are uneasy about is not its legality, but the
surreptitious way of dealing with other people. Intentionally and secretly
taping other people's conversation is certainly not candid. If a fiduciary
relationship exists between you and the person whose words you want to tape,
then it would not be appropriate for you to do so without his consent. For
example, as an attorney, I cannot tape the conversation with my clients
without his/her consent.
