The U.S. Education Department dismissed a complaint against Harvard
University alleging the school discriminated against Asian-American
applicants.
The government dismissed the suit on June 3 because a similar lawsuit is
being considered in federal court. The dismissal was reported earlier
Tuesday by Bloomberg.
The complaint was filed in May by 64 Asian-American organizations with the
Education Department’s Office of Civil Rights. It said the university has
set quotas to keep the numbers of Asian-American students significantly
lower than the quality of their applications merits. It cites third-party
academic research on the SAT exam showing that Asian-Americans have to score
significantly higher than other students to gain admission.
“We’re very disappointed because we compiled a lot of overwhelming
evidence and we expected they would take some action,” said Yukong Zhao,
who organized the coalition that filed the suit. “They really let the Asian
-American community down.”
The Office for Civil Rights said in a statement the case was dismissed
because “the allegations in the action filed against the University in
federal court were the same as those filed by the complainant with OCR.”
In November of last year a separate advocacy group, Students for Fair
Admissions, filed a lawsuit against Harvard, seeking an end to race-
conscious admissions because they said the school limited the number of
Asian-American students it accepted. Harvard denied that claim.
In May, in connection with the complaint filed with the Energy Department,
Harvard General Counsel Robert Iuliano said the college’s admissions
policies comply with the law. A spokeswoman said Tuesday that the school “
has demonstrated a strong record of recruiting and admitting Asian American
students” as part of its effort to build a diverse class.
