u must have h1b transfer petition receipt handy to say u r in "status
change pending", which is a legal status to stay not work.
as in ur scenario, i would think ur wife is actually out of status right
now before getting receipt, strictly speaking. but if her employer still
have another paycheck in next two weeks, or they plan to report to INS
later on, then she is legally staying here.
if illegal stay is more than 180 days then it will be in serious trouble,
but if it is just a couple of weeks

again u need ur receipt to make AOS pending status alive, which
is a legal stay status as h1b transfer pending. i would think
it is the same as H4 to make things complicated. plus, INS doesn't
have regulations over this kind of things, in my mind if u do
need a proof to be in this status then u need probably apply
an EAD to stay and work with AOS pending.

Here is my experience for H1-b transfer. Merely for your reference.
When I filed H1-b transfer request, my lawyer sent the material by FedEx. If
you have the FedEx number, you can get a copy of E-receipt online. It contains
the signature of INS receiver which you can print as your receipt. You should
be able to get the E-receipt within 2-3 days after sending the request, and
you may start to work with a very short transact period.
Don't know if other mail venders have similar thing.

there are different understanding on the receipt, because it is not clearly
secified by the law. some lawyer even take the copy of the fedex envelope as
the receipt. I don't think it will bring any trouble.

i believe it is a safer bet to use INS's receipt date as the day
h1b transfer petition filed so as to start work.
