各位高手，
我想请教一个关于EB类245K条款的180天问题。曾经没有continuously maintain
immigration status的人不能485调整。听说只要最近一次入境后maintain status，就
可以根据 245K提交485.也就是通过最后一次入境漂白。
我的律师说即使重新入境也不行不能交485，也不能漂白以前没有continuously
maintain immigration status的历史。到底律师说的对不对？

谢谢。我的律师说re-entering will not cure one's inability to adjust because
even if one re-enters lawfully, period out of status still exists and
occurred prior to most recent entry. 245(k) can only sure a period of 180
days if it actually occurred after the most recent entry.
也许对这个条款比较有争议。我看了皮匠和网上大家说的才以为这个条款只看最后一次
入境后违法不。没想到律师这样说。

身份违例不超过180天的可以交485
身份违例只参考最近一次合法入境之后这段时间
我不知道还有什么其他理解

This exemption applies to a foreign national who has not failed to maintain
a lawful status, engaged in unauthorized employment, or violated the terms
and conditions of his or her? ?admission for an aggregate period exceeding
180 days. When determining whether an applicant is eligible for? the ?INA
245(k)? ?exemption, USCIS only considers the time period following the
applicant’s most recent lawful admission.

245k原文：
An alien who is eligible to receive an immigrant visa under paragraph (1), (
2), or (3) of section 203(b) (也就是EB1， EB2，EB3） ... may adjust status
pursuant to subsection (a) and notwithstanding subsection (c)(2), (c)(7),
and (c)(8)
关键词may adjust status ... notwithstanding subsection (c)(2) ... (c)(8)
(c)(2)和(c)(8)是禁止过去身份违例的人在境内调整为绿卡的, notwithstanding (c)(
2) ... (c)(8) 就是说对满足245k条件（最近一次合法入境后违例小于180天）的人(c)
(2)和(c)(8)不再适用了，也就是cure了过去一切违例。
你去问你律师怎么解释notwithstanding subsection (c)(2), (c)(7), and (c)(8)

When you tried to re-enter the U.S., did you tell the truth that you had
been out-of-status in the past?
If yes, you are ok to use 245(k).
But if you lied in the Visa application or to the CBP officer, you may not
be able to use 245(k) because your last admission was based on willful
misrepresentation or fraud.
