求教：最近与学校housing的白女人打交道，此人是典型的white trash, 我对谈话作了录
音。在快结束的时候，我问丫，"why do you do that to me? why do you treat me so
bad? Is it just because I am a Chinese student?"丫说“yes."
我这么问她，是因为之前她曾经找岔处理过n多中国学生学者，丫手段是很恶劣的那种，
比如现让你写个解释，然后拿着那个东西说你撒谎dishonesty. 我这回虽然没有这样，但
丫也想在一封信里面玩弄措辞隐藏事实来charge我。
我现在想明确告诉她，我要一个apology for what you said. 请教可不可以行的通？我
是说，录音是没有事先通知她的，是否为法律所允许？

This needs to be answered by those who've taken Evidence. But intuition tells
me this should not have any problem at all.
The more important issue is, however, whether she is working for the
University. If that's the case, retain a lawyer (those on a contigency fee
basis--tell them you have the tape); also, you could ask for help from those
civil rights group--they are very willing to provide legal service, especially
if it's a strong case.

Evidence rules probably do not apply if the action is not brought in a
judicial court. The best course of action is to complain to the school. Get
some people who experienced similar treatments from this lady to act together
with you. If the school does not take appropriate actions, you can file a
complaint with a state agency responsible for enforcing anti-discrimination
laws. Racial discrimination is covered by both federal and state laws but it
is most like a state agency will be in charge of

谢谢回复。此人是学校的正式雇员，her title is "xxx park coordinator",总之就是
负责学校一个研究生公寓区的管理之类的。
这回主要是我太太(也是学校员工，非学生，不用担心身份的)违反了公寓parking
policy.但是此人想我来负全部责任，除了要我交一毕钱之外，要charge 我 "name on
file".估计是不是就是国内的”记过“。这是第一次谈话。完了她给来了一封信，里面有
许多不实之词。估计因为第一次谈话时我表现比较软弱，她认为我跟以前的中国学生一样
不会抗争，所以就有点乱写的样子。我很不份这口气。钱我同意交。我不同意其他处分。
我太太要约她谈话，她找理由说我太太不是lease holder，说不见。然后我要约她第二次
谈话，她同意了。第二天，她又发email说，约个时间，跟Housing Manager (就是她的
上司)一起谈。我的直觉是她害怕了，想用更大的压力来使我屈服。俺有点害怕，但还是
要顶硬上。
第二次谈话之前，专门咨询了学校的free的student legal services, 15分钟。那个白人
男律师，上来就吓唬我

I think this is a good call. Several other Chinese students in my/neighboring
deparments had similar experience before. I will try to see if they are
willing to act together.

Which state are you in? In New York the state agency is named "Human Rights
Comission." In California, it is called "Human Relations Commission."

There gotta be numerous such associations. You don't need to limit yourself to
anyone of them--if you have time, try them out one by one to see who might
offer the best help.

There gotta be numerous such associations. You don't need to limit yourself to
anyone of them--if you have time, try them out one by one to see who might
offer the best help.
BTW, what kind of school are you in? The response of the legal assistant, or
the "lawyer", seems to be very unprofessional. The manager's remarks also seem
to be quite out of the normal.
Anyway, if that's what you got, maybe you can also record the lawyer's
answer--maybe it's even easier to complain to ABA.

首先谢谢Soci 和 Liliz 两位的连续建议。
我在加州的公立大学。学校那个legal service律师就算了，懒得理他。他是外面一个律
师所得人，估计是跟学校有合约，为学生提供咨询的。
Housing Manager 这次的表现还可以。基本不压我，不太搀和。也许是我没说清楚，我所
引用的话都是她手下那个park coordinator说的。这个park coordinator很恶心，抓住中
国学生学者的一些错误和怕事心理，弄些tricks,造成同学既有错误又说过谎的事实，将
中国学生送上学生法庭(student judical affairs)，赶出学校公寓。(外面的要贵很多的
说。也不如学校的方便。)

do you ever hear of "equal opportunity office" on campus?
they usually deal with this kind of discrimination issues
and ensure the minorities on campus have the same human rights.
you can try to talk to them before you find a lawyer.

depends on your location
roughly speaking, in democratic states, you are in better situation.
in some severe redneck states, there is almost nothing you can do
unless you are really lucky.
file a group complaint to your school with a copy of your tape record
as well as the evidence of unfair treatment to Chinese people
may be the best way to solve the problem.
To raise a racial discrimination case is time/energy/money
consuming and you are not guaranteed to win. this is not that easy
to prove yo
