起因是做饭的炉子上方的microwave+hood combination (11个月新) 坏了。
leasing office打开microwave检查发现里面的电路板上面是一层油(grease)。换了
一个fuse,之后工作了几天,就又不工作了。现在我们自己也知道里面的油是我们造成
的,上一个微波炉也是同样的原因坏掉了(2006年10月),当时我们怎么也不相信电路
板里面的油是我们做饭造成的。我们据理力争之后,他们给换了一个新的,就是现在坏
掉了的这个。我们今年6月份renew了8个月的新lease,当时没有因为微波炉的事情搬走
的部分原因也是因为我们从去年10月份拿到新的微波炉之后到今年6月份,有8个月的时
间,微波炉工作的好好的。。。我们就误认为微波炉不可能因为我们cooking 用很多油
而再次坏掉。结果sign lease没有几个月,微波炉就坏了。
leasing office 先是让我们赔偿“microwave+hood combination + installation fee
"=$450.我们还在你来我往的argue中的时候,leasing office 发了一封

This is very sensitive issue. You's better move out ASAP since you have been
evicted. Pay all the moenyotherwise you will have serious trouble.
But, before you move out try to take pictures and get evidence that you are
not responsible for the damage of microwave and did not use EXCESSIVE oil
while you were cooking. You should try to prove: The damage of microwave is
caused by default problem of Microwave. Common sense tell us that Oil is
insulator, not conductor. Oil should not cause the breakd

查了一下 我们 州的 法律,好像leasing office 有权要我 付剩下的几个月的房租。

So you need to pay all the rent.
Get all the evidence. Get the information of your microwave, check it from
internet. Do some research.
Before you go to the court, buy one microwave. In the court, put some oil in
it. Turn it on, show the judge that the fuse can not be brokedown by oil.
Do everything legally.

我的原帖里面可能没有说的很详细。
微波炉里面电路板上的一层油不是因为我在微波炉里面用油造成的。我一年里面可能顶
多有那么几次用微波炉热个牛奶的啥的。
那一层油来自微波炉下面的炒菜的锅。。。炒菜的时候,油烟上升,直接“烘烤”微波
炉的面板和底部,不知道怎么的就进到了微波炉的里面,附着在电路板上了。

Again, get some information about this miocrowave. Do some research.
When you go to court, try to prove that:
1. The short-circuited microwave was not caused by oil. Common sense tell us
the oil is insulator, not conductor. As long as it did not caused by oil,
the landlord can not evict you. They try to say you used EXSSIVE OIL and the
OIL destroyed the microwave, isn't it?
2. The breakdown of fuse is NORMAL WEARING DOWN of cooking appliance. It is
inevitable and should not be the reason of evic

I forget to tell you that there are many landlords are very litigious and
greedy. They like to use all kinds of excuses to threaten the tenants. And
even evict the tenants. A lots of tenants refuse to pay the rent because
they thought the landlord broke the lease first. When they went to the court
without paying the rent, the judge usually on the landlord side since many
landlords hire lawyers.
So that's why told you that this is a very sensitvive issue and you have do
everything legally.

你应该找个律师研究一下你的房契,看看是不是像你理解的那样把微波炉搞坏了你就违
约了,而且违约的后果就是eviction。就算合同写成那样,律师也没准有办法帮你减少
损失或者倒打一耙将房东打倒。

我已经回答过你了,这个情况在纽约房东是没有权利既evict你又要求你付剩下的房租
的,即使Lease上是这么写的。不过也有的州的法律对房客比较差,你要讲清楚自己是
哪个州的,或许可以有办法。Landlord-Tenant Law的东西牵涉比较多的政府政策问题
,所以lease上的东西不一定作数的, 以本州相关法律为准。

楼主你签合约的时候他们有一条条跟你解释吗?还有lease有多长,字大不大,清不清
楚,lease上面说造成property damage的后果是什么?
如果他们之前没有给你adequate notice,合同字太小、看不清楚或夹在一大堆条款中
间,该条款不一定有效。
不过我还是建议先付钱,然后咨询律师上法庭,你造成的损失肯定不到4200美元,应该
有办法。

还有就是,上次微波炉坏了有说是property damage吗?如果没有的话,你就告诉法官
,even if I caused property damage, they LED me to think that I did not the
first time, so the second time I assumed it was not property damage either.

这个流氓房东要想把他赶走,必须打官司,等法院判决了之后才知道要不要搬。
这期间不知道要多少个月的时间。
如果房东真的流氓敢骚扰楼主甚至动粗的话,打911干死他。
