我最近咨询DOS关于豁免的事情,他们回复是,J1豁免后,你仍然可以出入境,不影响
豁免。但是J1再次延长,则需要重新豁免。

This XX, a Postdoctoral scholar from xx University. I am writing to inquiry
a complicated case.
I hold the J1 visa for more than 2 years, and this October I submitted the
J1 wavier application. Last week, my wife started to apply the J2 visa base
on my J1 visa, but she was was told that a background check about 3-4 weeks
is required before her visa is issued. I got this information as below http://visa.dgsom.ucla.edu/pages/faq:
"Q; Can I travel outside of the U.S. after I have received my waiver
approval of the Two Year Home Residence Requirement?
A: Once you or your dependent(s) travel and re-enter the U.S., you or your
dependent(s) will be subject to the Two Year Home Residence Requirement all
over again."
So I am worry about that my J1 wavier case may be approved in this month,
while my wife's J2 visa may be issued after my waiver approval. My questions
are list below:
If my wife's J2 visa may be issued after my waiver approval, does it mean my
we will be subject to the two year home residence requirement all over
again?
If that happen but my wife doesn't use the issued J2 Visa, is my J1 wavier
still valid? Or my wife has to retract her J2 visa application?
Is there any other options I can choose to save this situation?

Thank you for contacting the 212e Waiver Inquiries.
Yes, you can travel outside of the United States and return as long as you
have a valid visa.
Please be informed that obtaining an extension of a J-1 exchange program
after having been granted a waiver of the two-year home residency
requirement contained in Section 212(e) of the Immigration and Nationality
Act (INA) for that program automatically re-subjects the exchange visitor to
INA 212(e).
