问题现状:
签证办公室(Visa Office)通过对cut-off dates的控制,在财政年度(每年十月为财年第一个月)的前三个季度对职业移民类缓慢释放签证名额(比如在2011财年,职业移民类前三季度仅仅发出了年度总额58.6%的签证数),在最后一个季度才大幅度移动cut-off days放出大量没用完的名额。导致绿卡申请人的等待时间被延长。并且由于移民局资源有限,如果在最后一个季度没有及时处理足够的申请,绿卡签证名额就会被浪费(移民法规定,一个财年没有用完的名额不能挪到下一年使用)。近年职业移民绿卡申请严重积压,如果绿卡名额再被浪费,积压的情况就会被加剧。
按季度分配27%的职业移民绿卡名额的好处:
1. 能缩短绿卡申请人的等待时间(比如很多申请人就能在2011年拿到绿卡而不必等到2012年夏天);
2. 尽量避免绿卡签证名额的浪费
法律依据:
NIU聘请了专业律师对移民法进行分析研究,认为签证办公室目前的季度分配现状不符合移民法第201条27%限额规定的立法精神,我们需要做的就是敦促移民局提高效率依法办事。

As one of the manygreen card petitioners anxiously waiting for the
Department of State to cleartheir current backlogs, I am writing to urge
your serious and immediateattention to the discriminatory visa number
allocation process currentlyemployed by the Department of State.
Section 201(a) ofthe Immigration and Nationality Act has a strict 27% upper-limitation of annualquota for both employment-based (EB) and family-sponsored (FB) green card visause. 8 U.S.C. 1151(a) (2009). Despite the statutory mandate, the Department of State is treating EB
petitionersdiscriminatorily from FB petitioners. Take the first three
quarters of fiscalyear 2011 for example, the FB visas approved in all three
quarters of FY 2011 blatantlysurpassed the rigid 27% limitation while the EB visas approved during the sameperiods were significantly below the 27% threshold.[1]

As you may know, thereis a massive backlog in the EB-2 and EB-3 categories of green cardapplications. Numerous eligible visa applicants are waiting in line to submittheir Adjust of Status applications. During this long waiting period, whichnormally lasts for five years or more, most of these applicants are reluctantto start their own business or purchase houses or luxuries, because their greencards, eligible as they may be, are not secured yet and a H1 employment visa isnot one stable enough for them to feel at home.
Section 203(g)authorizes the Secretary of State to “make reasonable
estimates of the anticipatednumbers of visas to be issued during any quarter of any fiscal year.” 8 U.S.C. 1153(g) (2009). Hardly can anyreasonable person see the “reasonableness” out of assigning only 58.6% of theannual quota of employment-based visas to the first three quarters of a fiscalyear, with 41.4% of the entire workload left to the last quarter. In fact, overly conservativeallocation by the Visa Office in the first three calendar quarters has wastedinvaluable visa numbers in the past. Let alone theDepartment of State is doing this in an obvious and illegitimate favor offamily-sponsored visa applicants.
Therefore, weappeal to you to urgethe Department of State to stop the
discriminatory treatment immediately and assignon a quarterly basis a
minimum of 25% of the annual visa quota to employment-based applicants! If this changed, if the Visa Officeclosely monitored visa usage each month to ensure that the worldwide EB numberallocation hit the minimum 25% per quarter, then the EB-2 cut-off dates forboth China and India would move much faster in the first two calendar quarters, none of the visa numbers would be wasted and the current visa backlog would besignificantly alleviated. By a more lawful stewardship, the Visa Office canmake the current quotas work for everyone and reduce the need for theirenlargement.
