This is weird idea. With high house price, you pay more tax, commission fee, insurance fee etc. Plus, you are talking 5K. so 335K compares to 340K is no difference to me, not even mention u are doing fraud thing. Does not worth the effort.
tax is based on county appraisal, not related to sale price. commission usually for net sale price, so just offer a price and ask seller to pay $5000 to closing cost in the same purchase agreement.

it is not fraud. this $5000 can not be downpayment but can be anything list in closing cost.

You can ask for closing cost paid by the seller. Many people do it.

down payment has to be your money. but that money( $5000) can go to escrow account, check your loan broker the total amount about total closing cost. if you plan stay long time in the house, you can use that money buy rate down.
