特朗普将面对叛乱等多项刑事指控
当地时间12月19日,美国国会众议院负责调查2021年1月6日国会山骚乱事件的特别委员会(下称“特别委员会”)举行了最后一次公开听证会,宣布将向司法部提交多项针对前总统特朗普的刑事指控,至少包括四项:煽动或协助叛乱、妨碍官方程序、串谋诈骗联邦政府和虚假陈诉。
The House select committee investigating the Jan 6, 2021, attack on the Capitol voted Monday to send to the Justice Department for possible prosecution a recommendation that former President Donald Trump be charged with four crimes related to his attempt to overturn the presidential election.
The four criminal referrals include obstruction of an official proceeding, conspiracy to defraud the US, conspiracy to make false statements, and incitement of an insurrection.
特别委员会还在当天的最后一次公开听证会上,就其最终报告进行了投票,批准了对特朗普这几项刑事指控的“刑事转介”(criminal referral)。根据相关规定,特别委员会没有提告的权力,但能向司法部提出建议。
The move has no legal weight but marks the first time in US history that Congress has made such a referral for a former president.
The committee recommended this charge because they believe Mr Trump repeatedly attempted to stop or undermine Congress' certification of the election in the weeks leading up to January 6. They also say Mr Trump deliberately attempted to stop the process by instigating a mob to storm the US Capitol on the day of the ceremony itself.
The committee believes Mr Trump worked with others to impede the function of the US government and mislead the public about the results of the 2020 election.

Conspiracy to make a false statement
The committee claims Mr Trump and his backers' planned to submit a slate of false electors in key swing states who would have handed him the presidency in defiance of election results.
The committee argued that Mr Trump encouraged his supporters to come to Washington and cause havoc, and as the attack was going on, failed to take appropriate action to end the violence.
该委员在19日的投票决定,将特朗普涉嫌的刑事案件移交司法部门,即刑事转介。根据相关规定,特别委员会没有控告的权利,但可以向司法部提出建议,最终决定要由联邦检察官做出。
The committee’s referrals to the Justice Department carry no legal weight since federal prosecutors are already conducting their own investigation and are the sole deciders of whether to pursue charges against Trump.
The committee also voted 9-0 to approve its final report, which will include findings, interview transcripts, and legislative recommendations. The full report is expected to be released Wednesday.
The committee, which will be dissolved on Jan 3 with the new Republican controlled House, has conducted more than 1,000 interviews, held 10 public hearings, and collected more than a million documents since it launched in July 2021.
The select committee’s final meeting came on the two-year anniversary of Trump’s Dec. 19, 2020, tweet in which he urged allies to descend on Washington for a "wild" protest against the election results. Congressional and DOJ investigators view that tweet as a crucial turning point.
