If no asset and no kid, in CA, the easiest way is to file a dissolution
proceeding at court, see

But the procedure is different in every state, you need to talk to a family
law attorney near where you live.
A divorce decree can be granted on the ground of one party's assertion of
irreconcilable differences. It's only a matter of time and persuasion.

In the movie "American Beauty," Annett Benin clamored for a divorce, and Kevin
Spacey asked, "On what gtround?" That shut Ms. Benin up. I don't know which
state the characters were supposed to be living in.
As for one spouse refusing to grant a divorce, it depends on which state you
live. In Massachusetts (where I live) I have found no precedents that denied a
divorce under the circumstances. In New York state, there are many.
