女朋友，11月递交H1b申请。1月初要Rfe，1月5号显示收到。一直等，到今天发现“
denial”。。
。她的OPT2月13号到期，看到OPT结束还有60天grace period，不知道能不能用这个撑
到4月份
再申请一次？或者能不能fight一下，或者马上重新组织材料再申请一次？菜鸟，不太
懂到底该怎么
办。。。谢过各位大大！！

现在的 AP 和 EAD 捆绑在一张卡上，如果用AP 进入美国，有可能被视作使用 EAD 吗

我是一名中国大陆的高三学生。我从初一开始使用Google阅读器，阅读了很多敌台和公
共知识分子的文章（也批判态度地阅读共产党官煤文章），成为民主自由斗士。有些网

而看到英文维基上的Unethical human experimentation in the United States（后来
自己翻译到了中文维基），以及英国电视剧Torchwood: Children of Earth后，我对民
主的信心动摇了。
后来读到了《进化心理学》和《自私的基因》，于是我对政治思想的迷惑豁然开朗，原
来自私基因是让人们拥有不同政见的根本原因。历史上朝代的更迭、共产党的“错误”
、战争，人类的一切痛苦....都是由于基因对人类的控制。我的兴趣转向了进化学，希
望未来从事人类演化和社会学的相关研究。我的交流能力差，学习一般。我不要求高工
资，甚至不会结婚，只想探索科学的秘密。我想在大学学习生物，毕业后进入一家研究
院去研究人类演化和社会学，此愿望是否现实？

恩，是个办法。也就是学校发offer之前，到OPT结束这段时间，可以合法呆在US吗？谢

赶快问问公司是不是e-verify。
如果是的话赶快申opt extension.
只要递交了opt extension，原来的opt就自动延长180天，知道opt extension 被批

No.
But your status will change to AOS. If you want to change back to H-1B, you
will have to do a COS (change of status) or H-1B extension.

confused. so still considered used EAD when showing the combo card? Maybe
it's better to apply for H1B visa stamp instead of using the combo card. My
H1B just extended.

Similar questions have been discussed many times here. So far that is what I
understand. Bottom line, AP is like a visa, if you use that entering US,
your visa status is no longer H-1B, it will be AOS, and if you want to
continue as H-1B, you will do one of these: 1) getting H-1B visa stamp, then
not using AP in the first place. 2) Do the COS (I don't know how exactly do
it yet). 3) Do the H-1B extension (In your case not an option since you
just extended it).

为什么被拒已经不重要了，而且，在目前的经济形势下，appeal基本上就是浪费时间和
钱。赶紧弄个备份的身份最要紧。

这个皮匠老师虽然唠叨了点，但是基本搞懂了
有谁知道这个EAD/AP renew 要交钱不？貌似我今年用不到，明年就过期了。

在4月13日之前申请H1b并拿到receipt之后可以待在美国，但是要10月1日才能开始工作

如果是09年12月毕业的貌似是不能在11年4月延期到10月1号的
赶紧挂个语言学校吧
我的opt过期了。。h1-b才开始。。。。希望一切顺利。。

I am hesitant to advise you on H matters because I don't know about your
case. I can tell you that your work authorization in the US in F status
ends on the date your OPT ends (the date printed on your EAD). You would
require authorization in another category to work after the end date on
the EAD.
The cap gap OPT extension would not apply in your case allowing your OPT
to automatically extend. Once H visas become available on October 1 (in
2010 in your case), then the cap gap is not in effect
学校oie的人告诉我的你可以问问律师反正12月毕业的按照道理说是next year对于09
年就是10年
的gap。。11年就超过年限了就不可以自动延期了。。
good luck了。我现在的状态是不能工作，必须要h1-b被approve裁能够工作。

Thank you so very much.
问了个学校，5月份开学，可以随时递申请（OPT grace period内），I20会发的比较快
，算是
后路了。现在我们寄希望公司能快速知道被拒的原因，如果这样不知能不能再递一次
petition，
或者到4月1号再递。。。
公司HR和律师感觉也是稀里糊涂，连被拒都是我们通知他们，他们才查的。。。
